Office of the Registrar General update

Dear colleagues,

We hope you are well. In this update, you will find information on extended alternative signing options during COVID-19 for strata and community schemes, new and updated waivers, and how to use a Digital Drivers Licence to satisfy Verification of Identity requirements. 

The Commonwealth Attorney General’s Department is seeking public and stakeholder views on possible arrangements for a National Register of Enduring Powers of Attorney, with submissions closing 30 June 2021. 

The Real Property Amendment (Certificates of Title) Bill 2021 has now passed through NSW Parliament, allowing for the cancellation of paper certificates of title (CTs) in NSW. We are working towards a cessation date of 1 October 2021, with a formal announcement to come over the next few weeks.

Liens and equitable mortgages

Solicitors, conveyancers and lenders who hold a lien over certificates of title (CTs) are reminded to consider beginning to use other methods of securing payment. This form of security will no longer be available once the provisions to cancel CTs in the Real Property Amendment (Certificates of Title) Bill 2021 commence. Read more...

New Participation Rules and Operating Requirements Waivers

Update to Required Dealings Exceptions Waiver

As a result of industry feedback, ORG has updated the Required Dealings Exceptions Waiver to capture additional scenarios where a party is unrepresented. ORG will work with NSW LRS, ELNOs, and the broader eConveyancing community to investigate whether new single-party dealings for use by Subscribers can be developed. Read more...
