The Victorian Law Reform Commission will make recommendations about strengthening the law and guidelines to ensure AI is used safely in Victoria’s courts and tribunals.

Read the consultation paper and have your say by 12 December 2024.

We want to hear your views on the benefits and risks of AI, including the following:

Benefits of AI

  • Processing data and doing admin tasks very rapidly, which could make courts more efficient and reduce delays.
  • Providing people with legal education and legal advice in new ways.
  • Helping courts to communicate with court users.
  • Helping with dispute resolution.

Risks of AI

  • AI can make mistakes and the way it works is often unclear.  
  • AI programs sometimes make things up--hallucinations and deepfakes might be tendered as evidence. 
  • People’s data needs to be safe and private.
  • AI may have in-built biases against some groups of people, depending on the data used to train it.

What we are looking at

The VLRC is considering how using AI fits with fundamental principles of justice—making sure that judges, magistrates and Tribunal members are accountable for decisions, that trials are fair, and the law treats people equally.
