Good morning, everyone! It's another week, and we are almost at the end of a supremely crazy first quarter. I have a lot of friends who've been laid off, furloughed or had their wages sliced in half. It's a really hard time out there and I hope YOU are doing OK! In fact, I hope you're doing well, not just OK! Many of you have stimulus checks coming, which is great, so I hope it helps!
I've received some questions about what's happening with the courts and class actions and frankly it varies by state. Some states have judges that are cranking through paperwork since they're no longer attending hearings every day, which means cases are moving forward. In other situations, those state judges are getting moved to the criminal bench
to keep THOSE cases from clogging the courts, so NOTHING is happening. So what are our clients doing? The guys and gals fighting for your rights? They're still fighting for you!
I spoke to a friend on Friday who's filing cases every day but also including a "stay" on communications/filings for 90 days. He needs to file the case TODAY because of statute of limitations issues (the date at which a case must be filed by or else it'll get thrown out automatically) but once it's filed there's no rush on things. The SOL clock essentially stops and their client is covered. So have no fear! Trial attorneys are still getting your cases filed in order to make sure your voice is heard. They're also being understanding to defendants and not requiring them to show up or even reply to the
pleading until things have HOPEFULLY calmed down for everyone.
We're digging into Coronavirus related lawsuits as well. As anyone can imagine, we're hearing things like employers trying to (in my opinion) STEAL their employees stimulus payments. We're hearing from business owners whose businesses were shut down by the city or state, HAD insurance to cover losses, and got their claims denied. Of course,
there's also the price gouging for everything from toilet paper to face masks that eBay and Amazon are allegedly profiting from. Yes, those two companies are shutting down a lot of these immoral third-party sellers but they're not shutting them all down. Every sale puts money in their pockets.
