What is misconduct?
The ICAC Act defines misconduct as the conduct of a public officer which contravenes a code of conduct and constitutes a ground for disciplinary action, or other misconduct.
Does the Commissioner investigate misconduct?
The ICAC Act intends for the Commissioner to assist agencies to identify and deal with misconduct, which he does in a variety of ways. However, the Commissioner may investigation misconduct himself where the conduct is serious or systemic and he thinks it is in the public interest to do so.
