Royal Commission into Aboriginal Deaths in Custody requires urgent action 30 years on
The Law Council of Australia is calling for a comprehensive national response to address the vastly disproportionate imprisonment of Aboriginal and Torres Strait Islander peoples, 30 years on from the Royal Commission into Aboriginal Deaths in Custody (RCIADIC). In 1991, the Royal Commission concluded: “The conclusions are clear. Aboriginal people die in custody at a rate relative to their proportion of the whole population which is totally unacceptable and which would not be tolerated if it occurred in the non-Aboriginal community. This occurred because “too many Aboriginal people are in custody too often.” Yet in December 2020, the Aboriginal and Torres Strait Islander imprisonment rate was 2,333 persons per 100,000 adult
Aboriginal and Torres Strait Islander population, compared to the imprisonment rate of 208 persons per 100,000 adult population generally. Read more.
Government recognises need for cultural change to sexual harassment laws

The LCA and the ABA condemns violence towards lawyers in Myanmar
The Law Council of Australia and the Australian Bar Association strongly condemn the ongoing intimidation, harassment, arbitrary arrest and incommunicado detention of lawyers and judges by Myanmar’s military (the Tatmadaw) since the unlawful coup d’état on 1 February 2021. Read more.
Public consultation - Rule 42 of the Australian Solicitors’ Conduct Rules
The Law Council of Australia has released a Public Consultation Paper on a proposed revision to Australian Solicitors’ Conduct Rule (ASCR) 42. The Law Council is inviting comments and submissions by 7 May 2021. Read more.
Breach Reporting Regulations
The Business Law Section provided a submission to the Department of Treasury with respect to the exposure draft of the Financial Sector Reform (Hayne Royal Commission Response – Protecting Consumers (2020 Measures) Regulations 2021 (Cth), which sets out proposed amendments to the Corporations Regulations 2001 (Cth), the National Consumer Credit Protection Regulations 2010 (Cth) and related fees regulations. A national response to family, domestic and sexual violence is needed
A coordinated national approach to family, domestic and sexual violence, as recommended within the recently released final report of the House of Representatives Standing Committee on Social Policy and Legal Affairs’ inquiry into family, domestic and sexual violence, is a positive step in addressing this scourge on our community. Courting innovation: Australia’s judicial system in the context of COVID-19 Webinar
The Law Council of Australia hosted an online webinar titled ‘Courting innovation: Australia’s judicial system in the context of COVID-19’ on 24 March 2021. The webinar explored the greater reliance on technology by courts and tribunals during the pandemic and how it has assisted with access to justice issues. It also highlighted how this shift may also exacerbate accessibility concerns due to a digital divide in Australia and with varying levels of technological literacy and infrastructure.
