Not Offering a 401K? New Employer Requirements in 2021
Employers must automatically enroll their employees in the New Jersey Secure Choice Savings Program if they do not already offer their employees a 401(k) or another qualified retirement plan. The Program requires employers to establish a payroll-funded IRA savings plan for enrolled employees. Enrollment was to begin on March 28, 2021 but has been delayed. The NJ Department of Treasury will be issuing guidance in the coming months.

New Recreational Marijuana Law & Impacts on Employers
New Jersey's new recreational marijuana law has several provisions that affect employers. For example, employers may not refuse to hire or employ an individual who uses cannabis, unless failing to do so would place the employer in violation of a federal contract or cause it to lose federal funding. However, employers still are permitted to maintain drug- and alcohol-free workplaces and may require employees to undergo testing following specific guidelines.
