Intellectual property and copyright are back in the spotlight this month. In April, the Council of the European Union approved the Directive on Copyright in the Single Digital Market, which will soon require Member States to start legislating at a national level. Views on the Directive continue to be mixed – particularly around issues of freedom of expression and access – and several countries abstained or voted against the legislation. We will continue to follow the conversation closely and monitor the effects of introduced legislation on arts and cultural policies, as well as artists and cultural practitioners, in the region.

Debate on copyright reform has also been at the fore in Asia and Africa. In Japan, the Agency of Cultural of Affairs is considering proposed changes to the country’s copyright laws that are proving similarly controversial, further highlighting the challenge of both protecting intellectual property and defending free expression. In China this week, political advisors gathered to discuss revising the country's copyright law, calling for a ‘people-oriented philosophy of development’ to address the relationship between creation, protection and use of copyright. While in South Africa the country’s Copyright Amendment Act is due to pass into law, raising concerns for some of negative consequences for the creative industries.

At a global scale, World Intellectual Property Day took place at the end of April. This year it explored the role of innovation, creativity and intellectual property (IP) rights in the development and worldwide enjoyment of sports, highlighting the priorities we share across sectors. In the same week, the International Federation of Library Associations (IFLA) published an interview with the Director of the WIPO Traditional Knowledge Division, which provides insight into intellectual property issues and challenges particular to Indigenous Peoples, traditional knowledge and cultural expressions; the limitations of existing systems and legislation; and efforts underway to address them.

Looking forward, next month issues of intellectual property and copyright will also be explored during UNESCO’s seventh session of the Conference of Parties to the 2005 Convention on the Protection and Promotion of the Diversity of Cultural Expressions. During the Conference, 145 countries and the European Union will examine an Open Roadmap to strengthen Parties’ capacities to promote the diversity of cultural expressions in the digital age and examine innovative policy practices. The Federation will be represented at the Conference, and we look forward to reporting back with relevant updates.

Americas Cultural Summit, Public Forum: 28 June 2019

The Americas Cultural Summit 2019 will take place in Buenos Aires, Argentina from 27-29 June 2019, hosted by the Secretary of Culture of the Nation, Argentina in partnership with the International Federation of Arts Councils and Culture Agencies (IFACCA). The programme will explore the theme of Cultural Change in a Diverse Territory and will include a full day of sessions open to the public on Friday 28 June, as well as a Regional Chapter Meeting for Members. The Americas Cultural Summit 2019 will take place alongside the Creative Industries Market of Argentina (MICA) and bring together senior government authorities, public funding bodies, institutions and practitioners from the arts and culture sector across the region to continue conversations started at the inaugural Americas Cultural Summit held in Ottawa, Canada in 2018. The working languages of Americas Cultural Summit will be English and Spanish.

La propiedad intelectual y los derechos de autor vuelven a ser el centro de atención este mes. En abril, el Consejo de la Unión Europea aprobó la directiva sobre derechos de autor en el Mercado Único Digital, que pronto exigirá a los Estados miembros que empiecen a legislar en el ámbito nacional. Las opiniones sobre la Directiva continúan siendo controvertidas, particularmente en torno a la libertad de expresión y acceso, y varios países se abstuvieron o votaron en contra de la directiva. Continuaremos atentas a la conversación y haremos un seguimiento de los efectos de la nueva legislación en las políticas artísticas y culturales, así como en los artistas y profesionales de la región.

El debate sobre la reforma de los derechos de autor también ha sido un tema destacado en Asia y en África. En Japón, la Agencia de Asuntos Culturales está evaluando los cambios propuestos a la ley nacional de derechos de autor que están siendo igualmente controvertidos, lo que acentúa el reto de proteger simultáneamente la propiedad intelectual y salvaguardar la libertad de expresión. En China, esta semana se celebró una reunión de asesores políticos para debatir sobre la reforma de la ley nacional de derechos de autor, abogando por una “filosofía de desarrollo orientada a las personas” para tratar la relación entre la creación, la protección y el uso de los derechos de autor. Mientras tanto, en Sudáfrica está a punto de aprobarse el proyecto de Ley de Revisión de los Derechos de Autor, cuyas posibles consecuencias negativas para las industrias creativas han causado preocupación.

A escala global, el Día Mundial de la Propiedad Intelectual se celebró a finales de abril. Este año abordó el papel de la innovación, la creatividad y los derechos de propiedad intelectual en el desarrollo y disfrute mundial del deporte, destacando prioridades que compartimos en diversos sectores. En la misma semana, la Federación Internacional de Asociaciones de Bibliotecas (IFLA) publicó una entrevista con el director de la División de Conocimientos Tradicionales de la Organización Mundial de la Propiedad Intelectual (OMPI), que examina cuestiones de propiedad intelectual y desafíos específicos de los pueblos indígenas, los conocimientos tradicionales y expresiones culturales, las limitaciones de los sistemas y legislaciones actuales y las iniciativas en curso para abordarlas.

Mirando adelante, el próximo mes se debatirán también cuestiones de propiedad intelectual y derechos de autor en la séptima sesión de la Conferencia de las Partes en la Convención sobre la Protección y la Promoción de la Diversidad de las Expresiones Culturales. Durante la Conferencia, 145 países y la Unión Europea examinarán una hoja de ruta abierta para fortalecer las capacidades de las Partes para promover la diversidad de las expresiones culturales en la era digital y proponer prácticas políticas innovadoras. La Federación estará representada en la Conferencia y esperamos informar a la vuelta con noticias relevantes.

Cumbre Cultural de las Amércias, Foro Público: 28 de junio de 2019

La Cumbre Cultural de las Américas 2019 se celebrará en Buenos Aires, Argentina, los días 27 a 29 de junio de 2019, organizada por la Secretaría de Cultura de la Nación Argentina en colaboración con la Federación Internacional de Consejos de Artes y Agencias Culturales (IFACCA). El programa analizará el tema de Cambios Culturales en un Territorio Diverso e incluirá un día entero de sesiones abiertas al público el viernes 28 de junio, así como una reunión del Capítulo Regional para los miembros. La Cumbre Cultural de las Américas 2019 coincide con la celebración del Mercado de Industrias Creativas de Argentina (MICA) y reunirá a altas autoridades gubernamentales, instituciones de apoyo público a la cultura, instituciones y profesionales del sector de las artes y la cultura de toda la región para continuar el diálogo emprendido en la primera Cumbre Cultural de las Américas celebrada en Ottawa, Canadá, en 2018. Las lenguas de trabajo de la Cumbre Cultural de las Américas serán el inglés y el español.
