COVID-19-specific leave requirements under FFCRA, AB 1867, and most other local ordinances expired on December 31, 2020. (A few of the local requirements have been extended; for an overview of Paid Sick Leave Ordinances please see UCON’s updated chart, Paid Sick Leave CBA Waivers Statewide.) However, the Cal/OSHA Emergency Standards contain requirements to pay employees who must be excluded from the jobsite and sent home to self-quarantine. Whether “exclusion pay” is required depends on many factors, including whether the COVID-19 exposure was work-related and whether work is available while the employee is out due to COVID-19 or a COVID-19 exposure.
