CRITICAL COMPLIANCE RESOURCES

COVID-19 Notification, Reporting & Pay Requirements

January 11, 2021

To help members navigate and comply with the rapidly evolving COVID-19 notification, reporting and employee pay requirements for positive or exposed individuals, UCON has compiled the following resource digest:

Notification & Reporting Requirements

Three different laws/regulations - AB 685, Cal/OSHA Emergency Temporary Standards, and SB 1159 - require certain notification and reporting requirements, not all the same. The following resources can help you navigate these:

  • Summary of Cal/OSHA COVID-19 Emergency Standards

  • UCON FAQ - Cal/OSHA COVID-19 Emergency Standards

  • Cal/OSHA FAQ Related to COVID-19

  • Legal Memo & Guide - COVID-19 Exposure Notices (AB 685)

  • SB 1159 Memo & Contractor Compliance Guidance

  • CalChamber Summary Table - Cal/OSHA, AB 685, SB 1159

  • COVID-19 Notifications - Union Contacts

Additionally, UCON has created other templates to help you comply with documentation required as part of specific notification requirements:

  • Master COVID-19 Prevention Plan IIPP

  • COVID-19 Notice to Employees

  • COVID-19 Notice to Unions

  • COVID-19 Notice to Subcontractors

Employee Pay Requirements

COVID-19-specific leave requirements under FFCRA, AB 1867, and most other local ordinances expired on December 31, 2020. (A few of the local requirements have been extended; for an overview of Paid Sick Leave Ordinances please see UCON’s updated chart, Paid Sick Leave CBA Waivers Statewide.) However, the Cal/OSHA Emergency Standards contain requirements to pay employees who must be excluded from the jobsite and sent home to self-quarantine. Whether “exclusion pay” is required depends on many factors, including whether the COVID-19 exposure was work-related and whether work is available while the employee is out due to COVID-19 or a COVID-19 exposure.
