Joint Employer Regulations Updated Under the Fair Labor Standards Act
The U.S. Department of Labor announced final approval to the suggested updates under the Fair Labor Standards Act (FLSA) to regulate the status of joint employers. Under this change, employees may have (in addition to their primary employer) multiple joint employers who are required to pay them fairly. The update intends to provide clarity on how businesses may work together and gives a four-point test to determine if a working relationship is considered joint employment.

New Bills Will Enforce Employee Misclassification
Governor Phil Murphy signed a legislative package combatting worker misclassification and exploitation. The bills will crack down on employee misclassification in businesses by allowing stop-work orders against employers violating state wage, benefit, and tax law; providing assessment of penalties for violations in connection with misclassification of employees; and requiring employers to post a notice for their employees regarding employee misclassification, among others.

Discrimination Based on Hairstyles Declared Illegal
State officials signed new law declaring that discrimination based on hairstyles is illegal. The Create a Respectful and Open Workplace for Natural Hair Act, also known as the CROWN Act, updates the Law Against Discrimination and clarifies that discrimination against hairstyles historically associated with any races is prohibited and illegal. The law seeks to enact additional protections for people of color in the hiring process and workplace.

The Setting Every Community Up for Retirement Enhancement Act (SECURE Act) is a bipartisan act implemented in 2020 with various applications to make saving for retirement more manageable--including ideas for small businesses to offer plans to employees, plans for part-time employees, and rules for lifetime-income options. Catering to a new trend of employees working longer and retiring later in life, the act raised the required minimum distribution age and allows people to save longer.
