President's Column

Dear Members and Friends,

AIBC held its 2017 Annual General Meeting in Canberra on September 14. At this meeting I was elected National President, along with Dr Kathleen Turner as National Vice President, and Wendy Hartanti as National Treasurer. Together with our respective State and Territory Chairs, we are delighted to represent our organisation and its Members, and are committed to making a difference to the Trade and Investment relationship between our countries, particularly with the finalization of IA-CEPA imminent.

AIBC thanks PwC who kindly hosted the AGM and the day’s activities, which included meetings with key representatives from both the Australian and Indonesian governments, and members of the Indonesia-Australia Business Partnership Group.

IA-CEPA will surely dominate the landscape over coming months, with Round 9 of negotiations to be held in Bali in early October. With only one further round scheduled after that, we are in the home stretch. This is reinforced by Minister Ciobo’s visit to Jakarta on 20 September to meet with his counterpart Minister Lukita, during which a deadline of November was set to conclude the Agreement, and some agreed initiatives and focus areas were restated.

AIBC has reaffirmed its commitment to supporting the IA-CEPA process and its implementation, to make sure the benefits and opportunities are widely promoted, and that early gains can be reaped in both countries. Even once signed, the IA-CEPA will remain a living document, and AIBC will continue to provide support and input to ongoing enhancements.

IA-CEPA and Standards Harmonisation

The Indonesia—Australia trade and investment relationship is expanding. Two-way trade was worth $15.4 billion in 2015 –16 and is well positioned to grow in future years. Indonesia and Australia are currently negotiating an ambitious and forward looking Indonesia-Australia Comprehensive Economic Partnership Agreement (IA-CEPA) designed to enhance bilateral trade.

When implemented, IA-CEPA aims to not only create a solid framework towards a modern and dynamic partnership that goes beyond the traditional scope of a free trade agreement, it will also enhance and deepen bilateral cooperation on trade, investment and business climate issues.

The National Standardization Agency of Indonesia (Badan Standardisasi Nasional – BSN) and  Standards Australia have been working together on a Trade Enabling Standards Mapping Study to help inform IA-CEPA negotiations and stakeholders on the opportunities, issues and challenges for standards harmonisation, technical alignment and regulatory coherence.

BSN and Standards Australia invite you to contribute to a high-level standards trade related discussion  on the current and future market access opportunities and challenges for IA businesses. The interactive one day workshop aims to bring together a diverse group of key stakeholders including business government, regulators, bilateral business councils, trade and investment promotion agencies, and technical and professional associations, to share experiences/insights, exchange information and make recommendations that will help shape the Trade Enabling Standards Mapping Study.

Australia Considers New Anti-Slavery Legislation

At the Bali Process Business and Government Forum last month business leaders from across the Indo Pacific region, made a concerted commitment to support the implementation of strong common laws to eliminate modern slavery. The move was endorsed by the Minister for Foreign Affairs, the Hon Julie Bishop MP, who hosted the forum with her Indonesian counterpart, Ms Retno Marsudi.

Australia has already commenced an Inquiry into establishing a Modern Slavery Act with companies invited to make public submissions. The Modern Slavery Act would target companies earning more than $100 million per year and is intended to encourage Australian companies to do more to investigate and put in place measures to prevent transactions for goods or services that benefit from forced labour at any point in the supply chain.

Businesses subject to the Act would be required to publish a Modern Slavery Statement annually, which sets out the slavery risks the business faces along with its response. In higher-risk industries, like construction, resources or fashion, companies will need to show they’re doing more.

SMEs will not necessarily be immune as the SMEs in those supply chains will also need to report at least annually. Large organisations may put the onus of investigations on to their supply chain partners, so SMEs need to set aside resources to conduct due diligence.

Given an Anti-Slavery Act would increase public and corporate focus on this global problem, it is important for Australian businesses to start preparing now for how they would comply.

For further information regarding the Inquiry into establishing a Modern Slavery Act in Australia please click here.

Extending ESDM's Authority - Another Policy Flip Flop

Bill Sullivan of Christian Teo Purwono & Partners, looks at new regulations affecting companies in the energy, mining and oil & gas sectors.

"Indonesia’s Ministry of Energy & Mineral Resources recently issued a new regulation which would have further extended the scope of its interference in the internal affairs of companies operating in the energy, mining and oil & gas sectors. However, within a little more than two weeks and following widespread expressions of concern, the new regulation was revoked and replaced with yet another regulation that largely leaves the original position unchanged."
