Risk Management Seminar Programme 2016/2017

Thanks to all who have attended or have registered for the risk management seminars. The response to the seminars has been better than anticipated and we are currently organising further seminars to deliver in the next few months.

The feedback on the seminars has been very encouraging and they are achieving our aim of delivering targeted risk management seminars to address the different risk concerns of our insured's.

We urge you to attend the seminars. Every insured practitioner is entitled to two hours of no or low cost seminars. In addition, your firm may be entitled to a risk management discount on its next insurance application if it meets, inter alia, the practitioner attendance requirements.

 

What do you know about the Legal Profession Conduct Rules 2010?

In a recent seminar, respondents were asked if it was true or false that the standards for professional conduct of lawyers in Western Australia are set out in the Law Society of Western Australia Professional Conduct Rules.

Over 50% believed it to be true. You may have realised by the heading of this article that it is, in fact, false.

Perhaps more disturbingly, a third of the respondents had not read the Rules (by whatever name they knew them!), and nearly 50% did not have a copy of the Rules. We guess they thought they could access them on the net.

While we don’t want to put too much emphasis on what was a small sample, it is clearly a duty of all practitioners to have read and understood the rules that govern their conduct.

At Law Mutual (WA), we often have to guide practitioners to consider Part 4 of the Rules dealing with Conflict of Interest when informed of circumstances that may lead to a claim while they continue to act for the client involved. The pain of separation from a client that application of the Rules might bring about may be small compared to the pain of a successful claim against you.

Paula Bluemel, our Insurance Services Officer, joined us in February, 2013.  Paula has been active in the insurance industry for over 25 years, working with Household insurance products before moving into Commercial Lines products in 2007.
