Would you like to contribute to the future of law reform in Australia? Join the President of the Australian Law Reform Commission (ALRC), Justice Sarah Derrington, for a free seminar to discuss a range of future law reform inquiry topics suggested by the public, and contribute your ideas on the shortlisted topics. The Law Society of Western Australia is collaborating with the ALRC to hold this public seminar as part of a national conversation, giving Australians a say in what areas of law should be the focus of a law reform inquiry by the ALRC. More information can be
found at ALRC's website. Participants will have the opportunity to ask questions or comment on the shortlisted topics, and to offer ideas about how those topics might be further refined or developed. Shortlisted topics include: the Australian Constitution, freedom of the press, regulation of financial services, environmental law, technology and automated decision making, trusts, migration, statutory drafting and freedom of speech. Both members and non-members of the Law Society are welcome to attend. After the seminar, join us for refreshments and the opportunity to mix with colleagues and members of the ALRC in a relaxed environment. Supreme Court – Changes to the Consolidated Practice DirectionsThe following amendments to the Consolidated Practice Directions are effective 2 August 2019: PD 4.6.5: Insertion of a new direction which sets out the requirements for filing and enforcing a judgment under Part 6 of the Service and Execution of Process Act 1992 (Cth) and O 81B of the Rules and to clarify how the Court registers a judgment. PD 1.1.4: Insertion of new par 11(f) to create an exemption to mandatory filing using the EDS for documents presented for filing pursuant to Part 6 of
the Service and Execution of Process Act 1992 (Cth) and O 81B of the Rules. PD 4.1.2.2 (CMC List – Usual Orders): Insertion of par 30(g) requiring that documents in a trial bundle are separated by tabs. Amendments to pars 56 and 57 requiring that facts identified in a chronology are linked to the documentary source which will be relied on to prove that fact at trial.
Family Law Forms UpdatedThe Initiating Application (Family Court and Federal Circuit Court) and the Response to Initiating Application (Family Court only) have been updated. The amendments include: - changing the ‘gender’ options available in the forms
- updating the description of parties (e.g. terms like ‘wife/mother’ and ‘husband/father’ have been changed to ‘parent’, ‘grandparent’, ‘party to a
marriage’ and/or ‘party to a de facto relationship’), and
- updating definitions in the ‘legal words used in court’ in the kit information.
The updated kits and forms are now available on the websites: Additional time is needed to make these changes to the Commonwealth Courts Portal ‘guided’ version of the forms. To allow for these IT system changes, the ‘guided’ versions will continue to be accepted.
Surplus Texts Available at the Law LibraryThe Law Library at the David Malcolm Justice Centre is making available a selection of surplus texts for offer to the Legal Profession on a first-come-first-served basis. The texts are the remnants of the Practitioners Branch Library that was decommissioned in 2012.
