Medical Device Alert: IRS Implements Medical Device Excise Tax

Under recently updated health care regulations, manufacturers and importers of medical devices are now responsible for a 2.3% excise tax.
Included in the Patient Protection and Affordable Care Act (PPACA) is an excise tax on the sale of certain medical devices under Section 4191 of the Internal Revenue Code. Under the new tax regulations, medical devices will be charged a 2.3% excise tax. The tax applies to manufacturers and importers on sales of “taxable medical devices” after December 31, 2012. OIG Alert: OIG Advisory Opinion Approves Performance Based Compensation in Management Agreement

On December 31, 2012, the U.S. Department of Health & Human Services, Office of Inspector General (OIG) issued a favorable Advisory Opinion, 12-22, addressing a co-management arrangement between a cardiology group and a hospital.  The management agreement included a performance bonus paid to the group based on implementing certain patient service, quality, and cost savings measures associated with procedures performed at the hospital’s cardiac catheterization laboratories.
