NDIS Operational GuidelinesThe National Disability Insurance Agency (NDIA) has comprehensively updated its Operational Guidelines (OGs) concerning compensation in the NDIS context. The updated OGs include guidance in relation to the compensation provisions set out in the National Disability Insurance Scheme Act 2013 and the National Disability Insurance Scheme (Supports for Participants – Accounting for Compensation) Rules 2013. The updated OGs outline the NDIA’s
processes for recovery and the calculation of a Compensation Reduction Amount. Further information on compensation in the NDIS context, can be found at ndis.gov.au.

Pro BonoAll applicants have been means tested and assessed by Law Access as being vulnerable people with great difficulty self-representing. If you are able to provide any assistance, please email lawaccess@lawaccess.net.au. - Fines/bankruptcy: a vulnerable applicant seeks advice to manage orders regarding a fine and the cancellation of her driver’s licence.
- Equal opportunity law: initial advice is sought in relation to potential claims against an educational institution in relation to disability discrimination.
- Guardianship: an elderly applicant requires advice relating to guardianship and the living arrangements of his wife of 47 years, who suffers from dementia and was moved from NSW to WA without his consent by other family members.
- Care and protection: expressions of interest are
sought from lawyers with experience in care and protection matters willing to occasionally provide pro bono assistance.
- Pro Bono Panel to write wills for Aboriginal People: expressions of interest are sought for a panel of firms able to assist disadvantaged Aboriginal applicants with the preparation of free simple wills. A community legal centre (Knowmore) will communicate directly with panel members to arrange referrals. Some applicants will be based in the metropolitan area while others are in remote and regional Western Australia. Some applicants will require priority assistance due to poor health.
