Approval of Minutes Moya presented the March 2019 Minutes. With no need for discussion, Potter moved to approve the minutes. Seconded. Motion carries. Dolsby welcomed everyone to May 2019 Board Meeting and introductions were made. Jeremy Pisca joined the meeting at this time Legislative Report City of Boise Water Regulations Presentation – Rick Christenson gave a presentation to the board about Best Management Practices for Wineries. Their focus is on breweries and realized cleaning processes need to reach to wineries along with distilleries. They will be visiting wineries in the next couple of weeks. Christenson went over the current and upcoming BMPS (Best Management Practices). The upcoming BMPS will affect breweries, distilleries, wineries and rock shops. Their main focus is the pH levels coming down the drains. If wineries have any accidental discharges, they are to let the city know. They request contact the city at leave 24 hours prior to desired discharge for approval/scheduling. They will work with wineries to make sure regulations are realistic to finalize the BMPS by July 1, 2019. Next step would be to approve BMPS to City Council for adoption in September 2019 and have three months compliance from that. Kevin Wallis added to the point that pH levels are currently in code and they will work with wineries to make sure all BMPS are met. City of Garden City will also be present with the City of Boise to create the updated BMPS. Wholesale Beverage Establishments Presentation - Matt Walker, Department of Health and Welfare presented to the Board about Wholesale Beverage Establishments. Walker went through the Food Protection program guidelines and the Idaho Food Code that isn’t clear in listing specific requirements for wholesale beverage establishments. Under federal law wineries are food-manufacturing plants and Walker isn’t certain if the FDA has come to all Idaho wineries to do their inspections. Rule states that the State (State of Idaho) can come and regulate wineries if the FDA isn’t doing those inspections. There is a list of code rules that are included and they include but not limited to: · Facility must have an approved water source and approved waste water disposal · Hand washing · Food contact surfaces must be cleaned and sanitized in accordance with Chapter 4 of the Idaho Food Code · Storage of raw ingredients and finished products · Process of bottling product · Rodent and other pest control are to be employed by the establishment · Refuse must be disposed of in accordance with Chapter 5 of the Idaho Food Code Walker stressed if the FDA hasn’t been to your facility, please know the State of Idaho will come by to make sure all codes are being met. It was noted that this inspection is different from the ADA County health inspection. Idaho Wine Commission will distribute the updated code document when they receive from Walker. Mathew Walker left the meeting Growers/winemakers from Oregon side of the AVA to sit on the Board of Directors - Batt reminded the Board that in the past, IWC drafted legislation to add Oregon side of the AVA to sit on the Board that the Governor wasn’t interested in entertaining that idea. Batt is unaware of any other commodity that has anyone out of state sitting on the board. Bonded Wine Warehouse Legislation – The draft is written and has been submitted to DFM (Department of Financial Management). DFM is fully on board with this and IWC will bring this to the next legislative session. Wine Excise Tax – There was a meeting at the Governor’s office and the Governor will not accept any changes until everyone is on board. It was stressed that the IWC wants to make sure that the Idaho Wine Commission’s budget remains whole. Batt plans to meet with The Department of Ag in the next couple weeks. Pisca made the point that the percentage of alcohol in beer could be raised from 4% to 8.5% and could all agree to request an appropriation to the Governor to make up the difference. Dolsby proposed the question if there was one avenue to go down that’s better than the other and Batt stated that he has talked to the committees already and they wouldn’t like to increase the tax. Batt stated that if we do want an appropriation, the IWC will need to start thinking of this now. The plan is to continue to work together and come up with a plan. Rules Reauthorization - Every year the Legislature approves the rules in place. This year they were unable to do this. Governor Little has tasked each agency to go through their rules and cut any they no longer want in place. Christison has everything ready to submit to DFM and presented to the Board the rules that she places to submit. · Late penalty for assessments to be taken out · Cleaned up the verbiage Christison presented the changes she will submit to DFM. Sullivan was unanimously voted to be Chair of the Idaho Wine Commission Board of Directors. Financial Report Approve Expenses Christison presented the March/April 2019 financials to the board. With no need for discussion, Potter moved to approve the financial reports as presented. Seconded. Motion carries. Motion to approve Dolsby’s limit to sign checks up to $10,000.
