Legislative Update: Twinhome Sprinkler Bill Moves to Senate Floor; Rulemaking Bill up on Thursday

The pace continues to be brisk as BATC moves forward with its work on the Homeownership Initiative and other industry priorities. The definitional change to Townhomes described in SF 578 (Draheim, R-Madison Lake), was heard in the Senate Jobs Policy & Finance Committee and passed onto the floor. The discussion on the bill has evolved to focus primarily on whether or not the alignment of the definition of townhouse (from 2 to 3-unit dwellings) should be triggered by the legislature or by an administrative rulemaking process. If the bill is signed into law, the code would be amended to reflect the BATC v. DLI court decision that stated that
one and two family homes (twin homes) cannot be required to install indoor sprinkler systems. Later this week, a key element in the Homeownership Initiative will receive its first hearing when HF 1001 (Vogel, R-Elko New Market) is heard in the House Government Operations Committee on Thursday morning, prior to Housing Day at the Capitol. HF 1001 would allow a legislative committee to review and amend any rule related to housing if the proposed rule has $1,000 or greater impact on the price of a home. Examples of rules that could be reviewed by the legislature include the building code, energy code, plumbing code, construction
stormwater permit, and the RRP lead paint rule, among others. If this bill is signed into law, homeowners will have a substantially stronger mechanism to review affordability impacts of regulatory rules.
