2016 Legislative Session Update

BATC Moratorium Bill to Heard on Thursday

In a short session with little room for bills to move, BATC’s long-time priority of establishing a public notice and super-majority vote relating to a land use moratorium will be heard in committee on Thursday. HF 2585 is authored by Rep. Jim Nash (R-Waconia) and has two main provisions. The first is a standard 30-day public notice requirement for any local government considering a housing-related moratorium. The second is a requirement that a moratorium receive a 2/3 vote of the council prior to being imposed, matching the current standard for many other land use decisions. With a current moratorium in Lake Elmo and recent stoppages in Minneapolis and Golden Valley, this issue has drawn interest from local governments and environmental groups, who are likely to oppose HF 2585.
