Governor Vetoes Housing Moratorium Bill

Yesterday Governor Mark Dayton vetoed HF 330, a common-sense bipartisan housing bill that would have ensured property owners are given fair notice and a public hearing prior to the imposition of a housing moratorium. The bill also would have required a 2/3 vote of the city council for a housing moratorium, aligning it with the voting requirements for other major land use decisions. In his veto letter, Governor Dayton stated: “This legislation represents a step forward in providing notice and a voice for those potentially affected by an interim ordinance regulating a housing proposal. However, the requirement for a two-thirds vote of the City Council members present and voting on an interim ordinance related to housing proposals is an unnecessary exception to the general
requirement for a majority vote. The provision weakens local control and the rights of local community members. BATC will continue to work with legislative leaders and the Governor to try to find common ground on this issue in the closing days of the legislative session.

Less Than One Week to Go: Homeownership Initiative In the Mix
|
Multiple pieces of our Homeownership Initiative with the Minnesota REALTORS were included in HF 4, the Omnibus Tax Bill and SF 1937, the Omnibus Jobs and Economic Growth Bill. Both bills were vetoed by Governor Dayton on Monday. BATC advocacy staff will continue to work with legislative leaders and the Governor to try to find common ground on these issues in the closing days of the legislative session.

BATC Meets with DLI about New Sprinkler Law
|
BATC staff and a representative from the Regulatory Affairs Subcommittee were present at a stakeholder meeting with DLI officials last week. The department provided an overview of the changes following the housing industry's bill that removes the sprinkler mandate from twin homes. DLI has since provided final draft language for the rule.

Harstad v. Woodbury Hearing Set
|
On June 21, the Court of Appeals will hear arguments in the Harstad v. Woodbury case, which could have a major impact on the fees cities charge developers for road improvement. In March, BATC, along with Rochester-area developer Frank Kottscade and the National Association of Home Builders, filed an amicus brief in support of Harstad.
