June 30, 2017 FILING INSTRUCTIONS FOR ENDORSEMENTS AND CORRECTIONS ON FLORIDA HOME STATE POLICIES WITH MULTISTATE EXPOSURES To: Florida Surplus Lines Agents and Independently Procured Coverage (IPC) Filers From: Gary D. Pullen, Executive Director, Florida Surplus Lines Service Office Date: June 29, 2017 Subject: Filing Instructions for Endorsements and Corrections on Florida Home State Policies with Multistate Exposures The purpose of this bulletin is to provide instructions to Florida surplus lines agents and Independently Procured Coverage (IPC) filers for the filing and payment of endorsements and corrections on multistate policies where Florida is the home state of the insured. On April 28, 2016, the NIMA states adopted a resolution to terminate the Non-Admitted Insurance Multistate Agreement (NIMA) effective October 1, 2016. The resolution included a one-year runoff period, commencing on October 1, 2016 and ending September 30, 2017. As a result of this resolution and Florida’s withdrawal from the NIMA agreement effective June 1, 2016, the last day to report surplus lines policy data through the Clearinghouse system (SLIP or XML Batch) is September 30, 2017. Below are specific instructions for all Florida surplus lines agents and IPC filers when reporting endorsements or corrections on multistate policies effective July 1, 2012 through May 30, 2016. 1. ALL endorsements and corrections on Florida home state policies effective July 1, 2012 through May 30, 2016 must be filed in Clearinghouse SLIP or via XML batch on or before September 30, 2017. The Clearinghouse system will not be available for reporting endorsements or corrections on multistate policies after September 30, 2017. Florida agents and IPC filers should make every effort to file all endorsements and corrections prior to September 30, 2017. 2. Agents and IPC filers should audit all Florida home state policies reported through the Clearinghouse system and make any necessary corrections prior to September 30, 2017. Corrections to policy data filed through the Clearinghouse system will not be accepted after September 30, 2017. 3. Clearinghouse transaction fees will not be charged or refunded after September 30, 2017. The Surplus Lines Clearinghouse will no longer be operational after September 30, 2017. Therefore, the Clearinghouse transaction fee will not be charged or refunded for any endorsements or corrections to multistate policies after September 30, 2017. 4. Tax and Clearinghouse transaction fee payments for multistate policies will be due by November 15, 2017. The final invoicing for taxes and Clearinghouse transaction fees on multistate policies reported through the Clearinghouse system will occur on October 2, 2017. Customers will be able to access invoices, billing reports and pay taxes and fees through SLIP through November 15, 2017. Any payments received after November 15, 2017 will be returned. 5. After November 15, 2017, customers will no longer have access to Clearinghouse SLIP or the data filed in the Clearinghouse system for Florida home state policies. All customers should run transaction and billing reports prior to November 15, 2017 for transactions reported July 1, 2012 through September 30, 2017. Customers will not be able to run reports or make payments in SLIP after November 15, 2017. 6. Customers should continue reporting new and renewal multistate policies, and endorsements on those policies, effective June 1, 2016 and after through FSLSO SLIP. Clearinghouse SLIP and XML batch have been updated to prevent any transactions from being filed through the Clearinghouse system after September 30, 2017. Additionally, FSLSO SLIP and XML batch have been updated to accept new and renewal multistate policy filings, and any subsequent endorsements, where Florida is the home state. However, agents and IPC filers may need to contact third party vendors regarding revisions to agency management systems that may be necessary in response to this change. FSLSO will be sending additional information regarding the end of Clearinghouse operations and the reporting and payment of Florida taxes on multistate policies as it becomes available.
