CEO Update

Happy New Year and welcome back to this our first 2013 edition of the IIA’s Engage Newsletter.

It won’t be news to anyone that as we head into 2013 there’ll be a significant focus on activities surrounding the Hill in Canberra as our Federal Political Parties prepare themselves for an election year. Should the federal election take place sometime around September or October, this equates to only eight or so sittings weeks of parliament before an election is called, if not called earlier.

An impending election is likely to have an impact on the Government’s legislative program, therefore the government will need to ensure that its policies are well considered; balanced and prioritised heading up to the election in order to encourage continued growth in our economy and not stifle investment.

Towards the end of 2012 there was more than 200 Bills before the Parliament of which approximately 50 were before the House of Reps, 100 before the Senate and 50 awaiting Royal Assent.  With key policy reforms in areas including Tax, National Security and Convergence regulation it will be worth keeping a vigil on what takes priority for the government in 2013.

The competition watchdog [ACCC] has the task of assessing the Special Access Undertaking (SAU), re-lodged by NBN Co on 18 December 2012, including public submissions, while also continuing its governance over compliance of Industry with the Telecommunications Consumer Protection (TCP) code. The NBN rollout in 2013, including the ACCC’s acceptance or rejection of the SAU, will be one of many initiatives that will continue to be in the limelight leading up to the federal election and remain of significant interest to our members.      

When we look back at 2012 there has been many significant policy issues discussed, developed, introduced and debated over that time, with many of those issues still requiring further input, development and collaboration from industry and key stakeholders, including the IIA.

For the IIA, we will continue to engage with you on many of the issues that may impact on you with a view to ensuring that the IIA provides the ongoing leadership for our members and is well respected and listened to by government and policy makers alike across all political parties, as a leading body representing Australia’s Internet industries.

We will continue to:
1.    promote and facilitate the growth, technical development and efficient functioning of the Internet in Australia as an open system;
2.    raise consumer and small business confidence in using the Internet, particularly for purposes of e-commerce, and to initiate and support programs to realise that goal; and
3.    promote diversity and connectivity on the Internet by all reasonable means.

I’m pleased to welcome aboard Akamai as not only a new member of the IIA but also a major sponsor of our upcoming Gala Dinner.

Scholarship opportunity – Women in the ICT sector

Congratulations to IIA Members Hwei Oh, Marketing Manager, Australia and New Zealand, Sophos and Viollette Chan, Technical Support Officer from Gizmo who have been awarded this scholarship. Consideration is currently being given to a third applicant from the IIA member base.

The scholarships of up to $11,000 have been awarded to women working in the Information Technology sector within IIA Member organisations to assist their participation in the Advanced Leadership Program (ALP).

Developed by a consortium of educational bodies and industry experts, the ALP is part of a national initiative to increase Australia’s pool of executive level female leaders.

PJCIS inquiry into potential reforms of National Security Legislation

As previously mentioned in our December 2012 Newsletter, the Parliamentary Joint Committee on Intelligence and Security (PJCIS) inquiry into potential reforms of National Security Legislation has gone somewhat quiet.

The Committee is required to report back to the Parliament following consideration of written submissions and evidence given at public hearings. However, at this time, there still remains no definitive time as to when the Committee is required to provide its report, including any recommendations that may result from its Inquiry.

Given we have now entered into an election year and there has been delays in receiving the committee’s report, with only some eight sittings of parliament anticipated before an October election is called it appears unlikely that any significant legislative change resulting from these proposals will be seen before the election.

ALRC Copyright review

There still remains a significant amount of interest from industry and the public on the Australian Law Reform Commission (ALRC) Inquiry on Copyright and the Digital Economy.

The Commission’s task is to now review submissions received and release a Discussion Paper at a date to be advised following that review. A Final Report from the ALRC is expected to be delivered to the Attorney-General by 30 November 2013.

ACCC Consultation on NBN Co SAU

On 18 December 2012, NBN Co withdrew the Special Access Undertaking (SAU) it lodged on 28 September 2012 and re-lodged a revised SAU with the ACCC.

NBN Co stated that the withdrawal of its 28 September 2012 SAU and re-lodged 18 December 2012 SAU was a result of substantial development and improvement of its Wholesale Broadband Agreement (WBA), as part of concluding its Contract Development Process (CDP), and the need to align changes from that process with its SAU.

As a result the ACCC has extended its consultation period by one week with interested parties now having until 18 January 2013 to make submissions to the consultation paper and re-lodged 18 December 2012 SAU.

The ACCC must make a decision to accept or reject an SAU within six months of the receipt of the undertaking (i.e. in the case of the 18 December 2012 SAU by the end of May 2013), subject to its ability to extend this period and periods which are discounted from the assessment timeframe (such as when the ACCC is consulting on the SAU, or NBN Co is responding to any Notice to Vary issued to it).  

If the ACCC does not make a decision within the statutory time period, it is deemed to have accepted the SAU.

The IIA is continuing to work with an industry partner to jointly convene a "content forum" with interested members, now planned to be held in Sydney, Melbourne and Canberra during the first quarter of 2013.

We believe a forum of this nature to be extremely relevant in light of the structural, legislative and market changes taking place across all sectors of the Internet and Telecommunications Industry in Australia.
