PCS Webinar: People issues in introducing and managing change

It would be rare for any change within an organisation not to impact, sometimes profoundly, on the people working for it.  Given that the rate of organisational change is proportional to the exponential economic and technological changes employers are facing, it is imperative that anyone involved in managing people has a complete and up to date understanding of the risks involved with the mismanagement of change.  Our upcoming webinar highlights those risks and how to avoid them, whether it be during annual performance reviews, restructuring, economic downturns or contract renegotiations as well as analysing the issues which influence the success of the change such as communication and treatment of employees.

Since the Federal Court in Barker v CBA “Policies Should Be Better Scrutinised” gave further weight to and clarified the implied duty of mutual trust and confidence, employers can no longer rely on the written employment contract as being authority for the process of implementing change, especially where it involves redundancies and potentially repudiations of contract.  The questions that must be asked and issues that must be navigated are broader than the express terms agreed between the parties.

As part of the 2013 Schedule of PCS Events, Kathryn Dent, Director and one of the NSW Law Society’s Accredited Employment and Industrial Law specialists, will discuss:

• implementing changes and the implications of Barker v CBA in the context of introducing restructuring and redundancies;

• unilateral contract variations and managing the risks of legal action involved in even “minor” organisational change;

• communicating changes to the organisation – how, when, why; and

• how to look after the employees who remain “post-change” – why you should do this and how.
