Expansion of our practice in data and technology law:

David Rosenthal: New partner at VISCHER

In David Rosenthal, VISCHER’s data and technology law practice is gaining prominent backing. The already established and recognized VISCHER team headed by Rolf Auf der Maur until now will thus become one of the first addresses in Switzerland for legal issues in the areas of data protection, IT law and all facets of digitisation.

David Rosenthal is one of the leading Swiss experts on data and technology law. For approx. 20 years now, he has been advising companies and authorities on all aspects of data protection and digital business, as well as IT projects. The international legal directory Chambers describes him as "absolutely stellar", while Legal 500 refers to him as "outstanding" and Who Is Who Legal calls him "the most experienced data protection lawyer in Switzerland". He has written one of the leading commentaries on data protection. He is Secretary of the Swiss Association of Corporate Data Protection (VUD) and the Cross-border eDiscovery Privacy & Investigations Association (CeDIV), and has been a lecturer at the University of Basel since 1999 and at ETH Zurich since 2006. Before moving to Homburger in 2001 to work as a consultant, where his roles included setting up and managing the data protection practice, he worked as a software developer, journalist and legal advisor.

Head of Data & Privacy and eDiscovery

David Rosenthal will head VISCHER’s Data & Privacy practice group and set up a new practice group for internal investigations and eDiscovery. Together with Rolf Auf der Maur, he will further develop the technology law practice group (TMT). Since the law firm was founded under its current name in 2000, VISCHER has had a recognised and successful practice in technology law. The international legal directories Chambers and Legal 500 rate TMT and VISCHER’s data protection practice in the top segment. In recruiting David Rosenthal, VISCHER is further expanding its strong position in terms of data protection and complex legal matters in the area of digitisation.

Focus on data-based business models and products

VISCHER’s technology law team advises clients on all issues concerning data law, extending far beyond the legal area of data protection. These comprise the protection of trade secrets, aspects of data security, and topics such as the ownership of data and the principle of public access. The team focuses in particular on a pragmatic approach to advice so that innovative data-orientated business ideas and products can be implemented properly not just from a legal point of view, but also a practical and prudent one. This also applies to projects covered by the EU’s General Data Protection Regulation (GDPR). Its services include drawing up and negotiating contracts, dealing with the authorities and contractual parties responsible in Switzerland and abroad, and managing administrative proceedings or lawsuits. The team is especially well known for its expertise in advising communication, media and IT providers and companies in regulated markets such as banking and finance, healthcare, energy, life sciences, telecommunications and aviation.
