CEO Update

Welcome to the October edition of the IIA’s Engage Newsletter.

As we now enter into the last quarter of the calendar year, with Christmas approaching fast, the IIA continues its focus on prioritising key issues and engaging with you [our members] and key stakeholders.

As reported last month, the Parliamentary Joint Committee on Intelligence and Security (PJCIS) inquiry into potential reforms of National Security Legislation continues to make headlines, particularly the data retention proposals.  An update is provided in this Newsletter.

I recently had the pleasure of attending the Australia and New Zealand Internet Awards (ANZIA) at Old Parliament House Canberra. The ANZIA is an annual event celebrating the achievements of organisations, businesses and individuals that have made significant contributions to the development and use of the Internet in Australia and New Zealand. This year two IIA members were nominated for awards, Internode (now a subsidiary of iiNet Ltd) in the IPv6 category and Sophos for Security and Privacy. Congratulations to both companies for being nominated and well done to Internode. Internode became the first broadband company in Australia to offer IPv6 as a standard service and the judges agreed that Internode shows clear leadership in the industry and were a deserving winner of this years’ IPv6 Award.

In conjunction with the ANZIA, .au Domain Administration (auDA) with support from industry partners, including the IIA, convened the inaugural Australian Internet Governance Forum (auIGF) at the Realm Hotel in Canberra on 11-12 October. I attended the forum with interest and was pleased to catch up with some IIA member representatives. A summary of the forum is provided below.

As previously reported the IIA iCode Taskforce continue its work on the iCode review. The Taskforce is working together with key stakeholders to ensure the iCode is updated to reflect technology evolution and remains an important industry Code in addressing zombied devices that are ‘compromised’ by malware. A further update is provided in this Newsletter.

The IIA are looking to re-convene some of its Taskforces over the coming months covering issues such as the ALRC Copyright Review and the Convergence Review. More information is provided below or will be forthcoming shortly.

I’m pleased to announce that two new members have joined the IIA over last month, Australian Private Networks (Activ8me) and Australian Power and Gas. Welcome to both companies, I look forward to working with you and engaging on issues relevant to your business. I’d also like to remind all our members that I’m always available should you wish to discuss any issues that are of importance to you. Please don’t hesitate to send me an email or call me directly at any time.

A number of events still remain on the IIA’s calendar between now and Christmas, particularly our Nautical Policy Party on 29 November 2012 which is free for members, so please come along and RSVP as soon as possible, I’d love to see you there. Planning for the IIA Gala Dinner in February 2013 is also well underway, so mark this date in your calendar and refer to our website for more details on this and other IIA events.

Australian Internet Governance Forum
Canberra

The forum was opened by Chris Disspain - CEO auDA, followed by keynote speeches from Senator the Hon Kate Lundy and Senator Scott Ludlam.

Day one of the forum consisted of five panel sessions that covered topics such as the upcoming UN/ITU events including the World Conference on International Communications (WCIT), the PJCIS inquiry into intelligence and security including data retention proposals, a review of appropriate an copyright framework in light of the recent AFACT vs. iiNet High Court Case and the Optus TVNow decision and privacy, access and inclusion in the digital age.
Day two saw a number of more focused workshops elaborating on the panel sessions from Day one.

Some common themes and consensus that emerged from the forum included support for the Multi-stakeholder engagement model, a need for further stakeholder discussion on data retention proposals and balancing national security requirements with the privacy of Australians and the importance of industry, government, business and community engagement on digital inclusion and enabling the digital economy.

icode Review

As previously reported, the IIA icode Taskforce (Working Committee) are now approaching the pointy end of its review of the Code

The Working Committee are now working to finalise a re-draft of the Code, following input from Committee members, the DBCDE’s review process and in consideration of the recently published Australian Internet Security Initiative (AISI) report from the ACMA.

The ACMA research report identifies how AISI participants act on AISI malware reports and assist customers on their networks to resolve malware problems. It is based on interviews with 24 small, medium and large internet providers across Australia. The report also discusses potential improvements to the AISI. Further information on AISI can be found on the ACMA website.

The IIA Working Committee will now re-convene next week to consider and incorporate stakeholder input, update the Code accordingly and finalise the next steps.

World Conference on International Telecommunications

As many IIA members are aware, the International Telecommunication Union (ITU) World Conference on International Telecommunications (WCIT) is set to be held in December 2012 in Dubai and will consider revisions to the International Telecommunication Regulations (ITRs). In preparation for the Conference there has been ongoing activity both at a national and regional level in Australia.

The end of the preparatory process for Australian representation is nearing, with the final Asia-Pacific Telecommunity (APT) preparatory meeting scheduled for 30 October – 1 November in Bangkok. A meeting of key stakeholders is planned for this week which will be our final opportunity to negotiate regional positions ahead of the WCIT. Following this meeting, Member State contributions to the WCIT have been requested for submission by 3 November.

Interested stakeholders who still wish to contribute to the discussion on the wide range of issues and Australia’s positions should do so now, ahead of the final preparatory meeting and the WCIT.

This document was released by the ITU in July 2012 and includes all proposals for revision of the ITRs submitted to date. The document does not represent our views on the proposals, however it may assist in familiarising yourself with the issues that have been raised for discussion by ITU Member States.

ALRC inquiry into Copyright  law reform

As reported in last month’s Newsletter the IIA will be conducting a teleconference in order to canvass input from its members on the current Australian Law Reform Commission (ALRC) Copyright Inquiry.

A copy of the Issues Paper is available from the ALRC website

Submissions due by Friday 16 November 2012. The Final Report from the Commission is due to be delivered by 30 November 2013.

The IIA would like to ensure we capture the main issues of our members in order to provide a consolidated and overarching submission that represents your views.
Areas for consideration include how copyright is working in relation to:
 
·      Caching and indexing
·      Cloud
·      copying for private use
·      online uses
·      transformative uses
·      data mining
·      retransmission of free to air TV
·      fair dealing and fair use
·      should users be able contract out of exceptions

Last two weeks of November (Date TBC)

Plans are still underway to conduct a "content forum" with interested members. The IIA is current working with another industry association to jointly convene an event in both Sydney and Melbourne in the latter half of November this year.

The forum would look to cover topics such as:
- Content regulation and convergence (Convergence Review)
- Legislative and Regulatory framework
- The role of Self-regulation – Conditions for successful self-regulation
- The role of Government and Regulators
- International comparisons
- Regulation of content-based services from O/S markets in Australia.
- Consumer behaviours
