How the Courts are actively pushing mediation.

I was instructed on a case centering on a dispute between neighbours.  There were all sorts of involved legal issues at stake, including ownership of land, rights of way and restrictions on how the parties might use their properties in the future.  Court proceedings were commenced after a few months of initial wrangling. But on the very first day of the hearing and, due to the huge costs at stake, the Judge was extremely quick to encourage the parties and their lawyers to reconsider settling the matter. Read on. >

Case example: house sale misrepresentation.

This case related to a dispute regarding breach of contract and misrepresenation in the context of a property sale. After contracts were exchange, it came to light that the property’s rear garden did not have planning permission for residential use. The seller denied liability for misrepresentation.  The purchasers threatened court proceedings.  However, both parties expressed a willingness to mediate. This example shows how both parties achieved a swift resolution at a fixed cost of around £400 each. Read on >

Even if you don’t settle on the day, mediation always brings parties closer to a final outcome.

In this case, a customer was alleging that point-of-sale equipment they’d been supplied was not fit for purpose.  The supplier made an offer to pay money to the customer to settle the case, but the offer was rejected and the counter-offer considered out of the ‘ball park’. In this example we explore the positive impact that a perceived ‘unsuccessful’ mediation can have on the final outcome. Read on >
