Amendments to Fair Work Act 2009 and Paid Parental Leave Act 2010 regarding “Keeping in Touch Days”

Amendments to the Federal Government’s paid paternal leave plan take effect this month. These amendments allow employees on unpaid parental leave to take their keeping in touch days and still retain their entitlements under the National Employment Standards (“NES”).

Prior to the NES changes from 1 July 2012, an employee taking a keeping in touch day while on leave risked losing their NES entitlements to parental leave as it may have been regarded as a return to work and the ending of leave.
