Employment Tribunal Claims Fall

Statistics for the period from 1st April 2010 to 31st March 2011, published by the Ministry of Justice, show that there was an 8%  reduction in Employment Tribunal (ET) claims compared with 2009/2010, although the figure was 44% higher than in 2008/2009.

The general trend towards a reduction in the number of complaints reaching the Employment Tribunal is likely to be more pronounced in the future. This follows the Government’s announcement yesterday that, with effect from 1st April 2012, employees will require two years service rather than just one to pursue the majority of unfair dismissal claims. Additionally, it is proposed to charge an upfront fee of £250 to lodge a claim, with a further £1,000 fee to be paid by the Claimant when the hearing is listed.

HSE Fees Consultation

The HSE’s consultation on recovering costs for intervening in a business following a ‘material’ breach closes on 14th October.

The idea, known as Fees for Intervention, is that if the inspector has to take action following an inspection the duty holder at fault will be responsible for meeting the costs.
