Colorado Supreme Court Denies Appeal 

SDS Water Quality Certification Stands



Today, the Colorado Supreme Court unanimously denied the Pueblo County District Attorney’s petition for appeal of a Colorado Court of Appeals ruling upholding the state's 401 water quality certification for SDS. Today’s Supreme Court ruling completely resolves this issue and also ensures that SDS has a valid 404 dredge and fill permit for the project under the Clean Water Act.

 

"Colorado Springs Utilities believed all along in the state's approval of the SDS water quality certification and are pleased that today's Supreme Court decision finally brings this issue to closure," said John Fredell, SDS Program Director.

 

SDS continues to advance in compliance with all permits and is proceeding on time and under budget.
