IIA Supports Blocking Child Abuse Material

On the 9 November 2012 the Minister for Broadband, Communications, and the Digital Economy, Senator the Hon Stephen Conroy, announced that Australia's major Internet Service Providers (ISPs) will soon be blocking child abuse websites on the INTERPOL ‘worst of’ child abuse list.

There has been widespread interest and at times controversy over the Government’s previously proposed mandatory filter legislation. However, the Internet Industry Association (IIA) is pleased that the Government has now moved on from that previous discussion and is now focused purely on blocking access to illegal child abuse material.

The IIA previously supported the blocking of the INTERPOL ‘worst of’ list Internet industry moves on blocking child pornography Internet industry moves on blocking child pornography , which is consistent with Industry commitments to block access to child abuse websites and work with law enforcement agencies to meet their obligations under the Telecommunications Act 1997.

“ISPs recognise their role in assisting law enforcement agencies and meeting their obligations under the law. Blocking the INTERPOL ‘worst of’ list is a positive step in preventing Australian internet users from committing the offence of accessing child abuse material,” said IIA chief executive Peter Lee.

“It is of the utmost importance in our society that we help keep children safe from abuse at all times. The IIA praises the Government and the Australian Federal Police (AFP) for taking positive steps to ensure that community expectations are met and our children are protected.”

The IIA is supportive of the AFP now issuing notices to smaller ISPs and will work closely with the AFP and IIA members to assist them in meeting their obligations under Australian law to prevent their services being used for illegal activities.

The INTERPOL process for identification of websites for this list is rigorous and transparent. The criteria for websites to be included on the list and the complaints procedure for owners of blocked domains are all available on the INTERPOL website INTERPOL website

CEO Update

Welcome to the November edition of the IIA’s Engage Newsletter.
The past month has been yet another busy period for both the IIA and our members. With less than 6 weeks to go until Christmas the IIA is busily planning for our Gala Dinner in February 2013, working to further develop IIA initiatives such as the iCode, Family Friendly Program, Trust Marque and updating our website while continuing to engage with our members, government and key stakeholders on relevant and important issues.

On 9 November, the Minister for Broadband Communications and the Digital Economy, Senator the Hon Stephen Conroy announced that Internet Service Providers (ISPs) will be required to block child abuse websites on the INTERPOL ‘worst of’ child abuse list and as a result the Government has no need to proceed with mandatory filtering legislation.

The IIA has welcomed the fact that the Government has now moved on from its previous filter proposal and is now focused purely on blocking access to illegal child abuse material. The Parliamentary Joint Committee on Intelligence and Security (PJCIS) inquiry into potential reforms of National Security Legislation is still ongoing, an update is provided in this Newsletter.

The IIA iCode Taskforce has continued to make further progress on the iCode review over the last month. It is expected that a final re-draft of the code will be circulated to members and signatories of the iCode shortly for feedback.

As reported last month the IIA has reconvened a Taskforce to review the ALRC Inquiry on Copyright and the Digital Economy. The Taskforce, chaired by Patrick Fair, has drafted a submission which is being sent concurrently to members for comments. We would welcome and appreciated any feedback on the draft submission from you by Thursday 22 November in order for the Taskforce to finalise the IIA submission and forward to the Commission.

I’m pleased to again announce the addition of two new members to the IIA over last month, Safe Internet Access and Equinix.  Welcome to both companies, I look forward to meeting with you over the coming months and engaging on issues relevant to your business. PJCIS inquiry into potential reforms of National Security Legislation

The Parliamentary Joint Committee on Intelligence and Security (PJCIS) inquiry into potential reforms of National Security Legislation continues to make headlines, with particular focus on the data retention proposals. There have now been 232 submissions received by the Committee, including 30 confidential submissions, 6 marked TBA and a number of supplementary submissions providing answers to questions on notice from recent public hearings.
Following the Attorney-General’s Department (AGD) own submission (No.218) Attorney‐General’s Department (PDF 5,184KB) , officers from the AGD appeared before the Committee at a public hearing on Friday 2 November 2012 in Canberra after being previous cancelled in October. At the November hearing numerous questions were asked by Committee members on the data retention proposal, which included seeking further clarity on the definition of ‘metadata’.

ALRC Copyright review

As reported in last month’s Newsletter the IIA held a teleconference on Friday 19 October in order to canvass input from its members on the current Australian Law Reform Commission (ALRC) Inquiry on Copyright and the Digital Economy.

The IIA Copyright Taskforce, chaired by Patrick Fair, has drafted a submission which is being sent concurrently to members for comments. We would welcome and appreciated any feedback on the draft submission from you by Thursday 22 November in order for the Taskforce to finalise and send the IIA submission to the ALRC for their consideration.

The Final Report from the ALRC is due to be delivered by 30 November 2013.

ACCC Consultation on NBN Co SAU

On 12 November the ACCC released the first consultation paper on the Special Access Undertaking (SAU) lodged by NBN Co on 28 September 2012. The ACCC advised that it will host a stakeholder forum on the SAU in December 2012 with details to be made available shortly on its website. The SAU is available here and interested parties have until 11 January 2013 to make submissions to the consultation paper. The ACCC expects to release a draft decision on the SAU in March 2013.

The IIA is reviewing the ACCC consultation paper and NBN Co’s SAU with a view to making a submission.

2012 Cybersafety Summit for students, Melbourne

On the 24th of October, IIA exhibited at the 2012 Cybersafety Summit for students aged 8-12 in Melbourne. This event was organised by the Department of Broadband, Communications and Digital Economy and was hosted for primary school members of the Youth Advisory Group on Cybersafety (YAG) to share their online experiences and insights with the government and industry representatives. This year, 1,887 students representing 190 schools from across Australia participated in the YAG, including 1,078 primary schools students. Students have shared their online experiences on issues including cyberbullying, privacy and online gaming.

Among the main organisations who participated in this event were Media Authority (ACMA), industry experts from McAfee and the Australian Federal Police.  The event provided an opportunity to position IIA as a lead organisation in the cyber safety space and enabled IIA to promote its Family Friendly Program.  Contact and inquiries were made from Parents and Teachers and brochures about the Family Friendly Program and its Participants were handed out.

icode Review

As reported last month, the IIA icode Taskforce (Working Committee) are now approaching the pointy end of its review of the Code

The Working Committee has made further progress on the iCode review over the last month and it is expected that an updated draft of the code will be circulated to members and signatories of the iCode shortly for their comments/feedback.

Following final consultation with key stakeholders the Working Committee will finalise its re-draft of the Code for recommendation to the IIA Board for approval.

1st quarter 2013 (Date TBC)

The IIA is continuing to work with an industry partner to jointly convene a "content forum" with interested members, now planned to be held in Sydney, Melbourne and Canberra during the first quarter of 2013.

We believe a forum of this nature to be extremely relevant in light of the structural, legislative and market changes taking place across all sectors of the Internet and Telecommunications Industry in Australia. As such, given the remaining timeframe between now and Christmas, we have decided to postpone the forum until early next year in order to maximise the benefits and outcomes of the event.    

Further details and an update on the forum will be provided again in the New Year.

iappANZ Privacy Summit
23 November 2012

The fifth iappANZ Privacy Summit will be held on 23 November in Sydney bringing together on stage luminaries from government and privacy professionals in business and academia.
