January 5, 2018 Potential Legislative Changes Affecting Nursing Home Liability Coverage in Florida If you write nursing home liability coverage in Florida, you should be aware that several bills have recently been filed for consideration in the upcoming legislative session that will establish minimum statutory coverage limits for claims. Senate Bill 1408 (SB 1408), titled Nursing Home Liability, will require licensed nursing homes in Florida to maintain general and professional liability coverage in an amount no less than $1 million per claim. Currently, there are no minimum statutory limit requirements. Two additional bills, House Bill 655 (HB 655), titled Nursing Homes and Related Health Care Facilities, and Senate Bill 896 (SB 896), also titled Nursing Homes and Related Health Care Facilities, contain similar language and provide, as one of three ways to demonstrate the financial ability to pay claims, the option to obtain and maintain general and professional liability coverage of no less than $1 million per claim and a minimal annual aggregate of no less than $3 million from an authorized insurer as defined in s. 624.09, from an eligible surplus lines insurer as defined in s. 626.914(2), or from a Florida-domiciled risk retention group as defined in s. 627.942(9).
