Message from the CEO

Welcome to another edition of the IIA’s Engage Newsletter.
The last month has certainly been a busy period for the IIA and our members.   


There remain many issues on the agenda with my focus being continued engagement with you, our members, cybercrime and cybersecurity (including the Parliamentary Joint Committee on Intelligence and Security inquiry), content filtering (blocking), copyright and the iCode.  


As reported last month the IIA iCode Taskforce are continuing to review the iCode and are now working to finalise a re-draft of the code. I’d like to personally thank Ana Tabacman (Optus) and the Taskforce for their work to date on this important industry code. Please refer to the update in this Newsletter.


The Parliamentary Joint Committee on Intelligence and Security (PJCIS) inquiry into potential reforms of National Security Legislation is underway with 177 submissions received to date and the Committee having conducted its first public hearing in Melbourne on 5 September. The IIA has provided a submission to the Committee and it is expected to be authorised for publication shortly.   

 
I continue to work on the IIA’s strategic plan in order to prioritise the IIA’s issues and initiatives and set a clear agenda for the next 12 months and beyond. With the next meeting of the IIA Board due towards the end of September I will continue to communicate with you over the coming months on our strategy to ensure that we are focusing our efforts in the right areas.


The registration of the new Telecommunications Consumer Protections (TCP) Code, with new regulations governing the Australian telecommunications industry, commenced on 1 September.  The new code replaces the 2007 TCP code following a review that commenced in 2010.  The new code is enforceable by the Australian Communications and Media Authority (ACMA).  The new code attempts to address a number of consumer issues, both new and old, which were not adequately dealt with by the old code.  It also seeks to achieve an alignment with provisions of the Australian Consumer Law (ACL) which came into effect in 2011.


I’m very pleased to welcome the following new members to the IIA over last month, Eastern IT and RoarSearchMarketing and I look forward to meeting with you and continuing to engage with existing members. While I haven’t had the pleasure of meeting with all our members as yet, should you wish to discuss any issues that are of importance to you, I’d encourage you to send me an email or give me a call as I’ll be only too willing to assist.


Finally, don’t forget some of the events on the radar for IIA members over the coming months, such as the Australian Internet Governance Forum, our Nautical Policy Party and back again in February 2013 the IIA Gala Dinner. ALRC Copyright review

On 20 August, the Australian Law Reform Commission (ALRC) released the first consultation paper for the Inquiry about Copyright law.

Under the Terms of Reference for this Inquiry, the ALRC is to consider whether exceptions and statutory licences in the Copyright Act 1968 are adequate and appropriate in the digital environment and whether further exceptions should be recommended.

The Issues Paper is the first formal publication of the Inquiry, intended to help frame discussion and encourage public consultation at an early stage. It provides background information about copyright in the digital environment, highlights the issues so far identified in preliminary research and consultations, and outlines the principles that will shape the ALRC’s proposals for reform. It asks more than 50 questions about how the current copyright framework is affecting both commercial and creative enterprise and how current exceptions and statutory licences are working in the digital environment.

A copy of the Issues Paper is available from the ALRC website at
http://www.alrc.gov.au/publications/copyright-ip42 with submissions due by Friday 16 November 2012. The Final Report from the Commission is due to be delivered by 30 November 2013.

Given the relevance and importance of copyright issues to IIA members, we are looking to immediately convene a working party on the ALRC copyright inquiry.

Telecommunications Journal of Australia

The August issue of the Telecommunications Journal of Australia (TJAVOL 62, NO 4 2012) has nine expert papers on the theme of ISP copyright liability. Following is a list of those papers and their authors. The theme was stimulated by the recent Roadshow Films Pty Ltd & Ors v iiNet Ltd and the Optus TV Now cases, each requiring resolution in the High Court. Some of the papers also look at overseas issues for Internet intermediaries that could have potential consequences here in Australia as well.

icode Review

Following the IIA icode Review Forum held in June, the IIA iCode Taskforce (Working Committee) has compiled a draft report and undertaken a re-drafting review of the Code.

Key messages from the forum was the affirmation of the iCode strengths, flexibility in implementation and the voluntary nature of the scheme. The Department of Broadband, Communications and the Digital Economy (DBCDE) are also conducting reviews of the Code acknowledging its importance on reducing Cybercrime, while also providing an effective means for identification, notification and rectification of infected devices.

As reported last month the IIA Working Committee is continuing to review the iCode and are now working to finalise a re-draft of the Code. At this stage the next steps are as follows:

1. The Working Committee is currently reviewing a re-drafting of the iCode which is due to be completed mid-September.

2.  Further changes will be made following Working Committee’s input, which also incorporates input from the latest DBCDE discussions.

3.  A meeting of the Working Committee to discuss and progress the next draft and next steps for getting broader input / consultation will be conducted.

ALRC inquiry into Copyright  law reform

PJCIS inquiry into potential reforms of National Security Legislation

The Parliamentary Joint Committee on Security and Intelligence (PJCIS) inquiry into potential reforms of National Security Legislation is underway with 177 submissions received to date. Further information here. The Committee has conducted its first public hearing in Melbourne on 5 September with further hearings expected over the coming months. Details of public hearings, programs and transcripts can be found here.

The IIA has provided a submission to the PJCIS and it is expected to be authorised for publication shortly.  Once authorised by the Committee we will make it available on the IIA website

As reported in our last Newsletter, in light of recommendations from the recent Convergence Review Report and discussions around copyright, including the ALRC inquiry, the IIA is still looking to conduct  a "content forum" with interested members. It remains important that a clear understanding of industry views on a framework for content regulation that promotes innovation and competition in Australia while also protecting the intellectual property rights of content providers and educating consumers is represented appropriately to government.

As such the IIA is working is still committed to holding a forum during Q4 this year, should there be sufficient interested from members.  If you are interested in participating in such a forum, I’d encourage you to email IIA CEO Peter Lee. Further updates will be provided accordingly.

Australian Internet Governance Forum
11 & 12 October 2012

The first Australian Internet Governance Forum will be held at the Hotel Realm, Canberra on the 11 & 12 October 2012.

The auIGF is based on a multi-stakeholder model established by the United Nations. The forum will bring government, industry and community members together in an open, apolitical forum , to discuss internet related policy issues, exchange ideas and best practices, and help shape the future of the internet in Australia.

"The collaborative nature, timing and agenda of the forum is strongly supported by the IIA" said Peter Lee, CEO of IIA. "Given significant focus on issues such as security, privacy and convergence in a digital world, it's important to facilitate open discussion of those issues with all stakeholders."
