Transitional arrangements for behaviour support plans

This alert is being issued to clarify the ‘Transitional arrangements for behaviour support plans’ alert that was issued on 27 January 2021.

The National Disability Insurance Scheme (Restrictive Practices and Behaviour Support) Rules 2018 (NDIS Behaviour Support Rules) includes requirements for registered NDIS providers about the use of what the rules call regulated restrictive practices.

Are you a registered NDIS provider using a regulated restrictive practice for an NDIS participant in WA? If so, the transitional arrangements under section 26 of the NDIS Behaviour Support Rules will apply to you if:

  • the use of the practice has been authorised under the WA authorisation process for restrictive practices and
  • the use is contained in a behaviour support plan for the participant that also contains alternative behaviour support strategies

The transitional arrangements require the registered NDIS provider to notify the NDIS Commission about the plan by 28 February 2021 (unless the Commissioner allows it to be submitted by a later date) using the section 26 notification form. This is a registration condition.

If the notification is not submitted to the NDIS Commission by the deadline the transitional arrangements will stop applying.

More information is available on the Behaviour support page of our website.
