Further to our most recent update, the Victorian State Parliament passed legislation yesterday in relation to COVID-19 rent relief measures (the Rent Relief Act).

Unfortunately, much of the detail regarding the operation and implementation of the Rent Relief Act will be included in Regulations which have not yet been made (but they are expected any day).

 

At this stage, we know that the Rent Relief Act is broadly consistent with the mandatory code of conduct published by the Federal Government.

It also appears that the application of the Rent Relief Act will be broader than anticipated (that is, it extends both to ‘leases’ and ‘commercial licences’ which might include franchise outlets and perhaps even co-working space membership agreements).

We expect to be in a position to provide more definitive advice on the Rent Relief Act early next week – by which time it is hoped that the Regulations have been made.
