Further revision will occur in the months ahead when the Cannabis Regulatory Commission sets forth its requirements for employers. In municipal meetings throughout New Jersey, elected officials are learning a new vocabulary as they wrestle with setting local policies on the sale and public use of marijuana. The Philadelphia City Council approved a measure April 22 prohibiting most employers in the city from testing new hires for marijuana use. On Thursday, U.S. lawmakers introduced a bipartisan, bicameral bill to study the various impacts of state-legalized cannabis programs. As the trend to legalize cannabis use continues, employers should note that some state and local laws now protect workers who consume recreational marijuana while off duty. As a wave of marijuana legalization continues to sweep the country, employers (especially those with multi-state operations) must grapple with its impact on their operations and workforce. The American Cannabis Nurses Association calls for elimination of pre-employment and random drug testing for nurses and instead use a reliable test for impairment while on the job. Scott Martin, a 12-year veteran with the Buffalo Fire Department, was fired from his job earlier this year because he tested positive for marijuana.
