The NJ Cannabis Regulatory, Enforcement Assistance and Marketplace Modernization Act was signed into law by Governor Murphy on February 22, 2021, thereby legalizing recreational use of marijuana by adults 21 and over. The Partnership for a Drug-Free New Jersey will continue to keep our members updated on this important issue. Our tool kit is currently undergoing revision to provide updated information on policies and procedures related to the law to assist you in maintaining a healthy, safe and drug-free workplace. On April 13, 2021, the New Jersey Supreme Court issued a unanimous decision in Hagar v. M & K Construction. The New Jersey Supreme Court dealt medical marijuana patients a big victory Tuesday, ruling unanimously that a construction company must pay for an injured employer’s medical cannabis bills. New Jersey recently became the newest state to clarify the interplay between marijuana legalization and employment with the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act, or NJCREAMMA. It took more than four tortuous years — and the creaky machinations of New Jersey Democratic politics — before adult-use marijuana was legalized earlier this year. Now, the hard work actually began Monday with the first meeting of the state’s Cannabis Regulatory Commission On March 31, 2021, Governor Andrew Cuomo signed the Cannabis/Marijuana Regulation and Taxation Act (the “Act”), which legalizes recreational cannabis use for adults aged 21 and over. Workers who reported using cannabis before or during a shift – including supervisors and people in safety-sensitive jobs – had jobs and work environments in which detection was less likely, according to the results of a recent study out of Canada.
