WHS duties in a contractual chainSafeWork Australia has released a fact sheet for PCBUs who are working as part of a contractual chain (where in a project or work matter there are multiple contractors and subcontractors). Within the University, this may occur where we are working with others to establish or participate in research undertakings, update technology or infrastructure, or in staging events. Depending on the situation, WHS duties may be owed by different parties (PCBUs) in a contractual chain as illustrated in the diagram from the fact sheet. Importantly, the University in contracting out activities still owes a duty to its contractors, sub-contractors and their workers. WHS duties are not transferrable. Duties cannot be contracted out to another party in the contractual chain, such as a subcontractor. In a contractual chain there will be multiple PCBUs who share the same WHS duties. PCBUs who share duties must each discharge their duty to the extent to which they have the capacity to influence and control the matter. By all parties consulting, cooperating and coordinating activity, unnecessary duplication of activities will be avoided and gaps in managing health and safety risks prevented.
