• Receives donations in the form of memorials
• Receives a love offering for your pastor

Your church has had givers request the following be put on their contribution statement:
   • Supplies they purchased to fix up their Sunday School room
   • VBS supplies they purchased and are donating to the church
   • The value of time they invested on your church work day

Legal Matters: Forming a Legal Entity in the Church

Forming a legal entity called a corporation is a vital part of the churches structure.  Some nonprofit and religious organizations are incorporated for a specified number of years. Leaders are often unaware of such a limitation, and the corporation status can expire without notice.

Many churches and nonprofit organizations are incorporated under state nonprofit corporation laws that require annual corporate reports to be filed (such as Illinois). The annual reports are simple forms and due at the same time each year according to when your church or nonprofit was incorporated. The annual report updates your incorporation data such as the names of the current officers. If you’re church or nonprofit organization is incorporated under such a law, failure to comply with the annual report requirement will result in the lapse of the corporation status putting all members at personal risk and responsibility. 

If your nonprofit corporation has been dissolved it can be reinstated by filing the missing annual reports, paying all annual fees plus any late fees. If your registered agent has changed you will need to update the registered agent information. Read more
