Review EC Resolution 261

Presently the EC Resolution 261 is under review. Stake holders have presented their points of view.  Airlines and their associations mainly considered that the financial cost of the Regulation is excessive, particularly that airlines face unlimited liability for incidents which are not their fault (e.g. volcanic ash cloud crisis in April 2010). The airlines heavily criticised the consequences of the Sturgeon judgement – i.e. the right to financial compensation in case of long delay – as causing excessive costs to the sector.

The Commission has assessed various policy options in view of improving the application and enforcement of air passenger rights. An amendment of Regulation EU 261 is currently in a draft stage and, once finalised, will be presented to the EC for discussion with the members States. Once approved the amendments need endorsement by the EU Parliament. It is not clear by when the amendments of the Regulation EU 261 will be incorporated.
