Use of falsified NDIS Checks

The Screening Unit has become aware of the use of falsified NDIS Check clearance certificates to gain employment in the NDIS sector.

The use of falsified NDIS Check clearance certificates is criminal activity which places people with disability at risk of harm. The NDIS Worker Screening Unit will respond to identified incidents accordingly.

An individual who engages in a risk assessed role for a registered NDIS provider using a falsified NDIS Check clearance certificate faces potential investigation by three separate government authorities. 

  • The NDIS Worker Screening Unit investigate breaches of National Disability Insurance Scheme (Worker Screening) Act 2020. Working without a valid NDIS Check clearance is an offence under the Act which carries a maximum penalty of imprisonment for 5 years and a fine of $60 000.
  • The NDIS Quality and Safeguards Commission investigate breaches under the National Disability Insurance Scheme Act 2013 (Commonwealth).  The Code of Conduct requires workers who deliver NDIS supports to act with integrity, honesty, and transparency. Civil penalties apply to breaches.
  • The WA Police Force investigate offences under the Criminal Code.  Forgery and uttering is a criminal offence and incidents will be reported to Police for investigation.
 

What can registered NDIS providers do? 

The NDIS Worker Screening Database allows NDIS providers to verify and check the NDIS Worker Screening clearance status of workers. It is important to make sure you have verified and linked your workers in the Database before allowing them to start or continue in NDIS work.

The NDIS Check clearance certificate is not intended for employers to rely upon as evidence of eligibility to work.

If you notice something abnormal about a person’s NDIS Check, contact the NDIS Worker Screening Unit on 1800 225 558 (select option 1) and ask to speak with a member of the Compliance Team.
