Sector UpdateUpdate: cancellation of Registered Training OrganisationsDear services and providers As you will be aware, regulatory action taken by the Australian Skills Quality Agency (ASQA) has potential impacts on Western Australian early childhood educators, services and providers. This follows the important update we shared with you on 8 November 2024. In addition to the cancellation of the RTO Luvium Pty Ltd, we have been informed that Gills College, trading as Elite College Australia and/or Sterling Business College has been cancelled as of 21 November 2024. ASQA is now commencing a process to issue notices of intent to cancel a number of qualifications and/or statements of attainment issued by Gills College for the period 7/1/2022 to 21/12/2023. Anyone who thinks they may be impacted by this should contact ASQA - refer to the ASQA website for further information. In regard to the Luvium regulatory action, ASQA has now notified all affected students and, as the seven day show cause timeframe for response has now passed, has commenced cancelling individual qualifications. We now understand that around 300 individuals were located in Western Australia at the time they gained their qualification. We do not know how many are currently working in early childhood education and care (ECEC) in Western Australia, but ASQA has commenced the process of contacting potentially impacted employers.

Ensuring the health, safety and wellbeing of children is a critical component of the National Quality Framework (NQF) and qualifications are mandated under the NQF to ensure the provision of safe and high-quality outcomes for children in education and care services across Australia. Our priorities are the health, safety and wellbeing of children. We will work with providers and services to support them to meet regulatory requirements and operate safely. All steps to mitigate any potential risk to the health, safety and wellbeing of children will be prioritised and, where required, decisive action will be taken by the regulatory authorities. It is critical that providers actively manage the potential risks arising and engage with ECRU for assistance if they have any concerns about their ability to maintain ratios, provide appropriate supervision and run a child-safe service. Relevant federal, state and territory regulatory authorities, as well as ACECQA, are working closely with ASQA and the sector to ensure that those working with children have completed the full requirements of their qualification.
