CEOs of Perth-based disability service provider found guilty of NDIS Check breach

An NDIS Worker Screening compliance investigation has led to a prosecution in the Perth Magistrates Court. The two chief executive officers were fined a combined $10,000 for not obtaining valid NDIS Checks and ordered to pay $500 each in costs.

 

Information for registered NDIS providers

Being a registered NDIS provider is subject to conditions. One of these conditions is ensuring workers in risk assessed roles, including key personnel, hold a valid NDIS Check.

Key personnel include people who are: 

  • responsible for executive decisions.
  • responsible for, or have authority or significant influence over, planning, directing or controlling provider activities.

This includes CEO's, executive staff, managers and/or board members.

The NDIS Worker Screening Unit’s Compliance Team carry out proactive compliance activities and investigations to ensure workers in risk assessed roles, including key personnel, are doing the right thing when it comes to NDIS Checks.
