NSW Operating Requirements for Electronic Conveyancing
version 6.2

NSW Operating Requirements for Electronic Conveyancing version 6.2 commences on 20 June 2023. Operating Rule 5.4.3 was amended to ensure the current CPI limitation on fee increases continues until at least 30 June 2024.

Participation Rules Waiver
PR 1/2023 – Certifications

NSW Participation Rule Waiver PR 1/2023 – Certifications commences on 1 July 2023. The partial waiver will allow the continued use of the wording of the Certification Rules in Schedule 3 of Version 5 of the Participation Rules, as the wording of Version 6 is yet to be implemented in the Electronic Lodgment Networks.

 
 

Client Authorisation form
version 6

All Subscribers must ensure that they are using the latest Client Authorisation form (version 6), which can be found at Schedule 4 of the NSW Participation Rules for Electronic Conveyancing. The Client Authorisation smart form is available on the ARNECC website.

 
 

Notice to Mortgagees and Subscribers acting for Mortgagees

NSW has released an updated addendum to the National Mortgage Form (NMF) on 19 April 2023. The updates are minor amendments to the Information Sheet that is attached to the NMF. The amendments are due to the changes to the Corporations Act 2001 (Cth) which was passed in 2022 to create a permanent statutory mechanism for the electronic execution of company documents (including deeds). The addendum can be found on the ARNECC website.
 
NSW Office of the Registrar General (ORG) understands that mortgagees may need time to implement the addendum in their mortgage process. For the purpose of subscriber compliance only, ORG will allow mortgagees to continue to use the previous addendum (dated 17 January 2019) until 1 July 2024.

 
 

Subscriber compliance information sheet

Please see our information sheet for guidance on the Compliance Examination process in electronic conveyancing. We would like to remind Subscribers about their obligation under the NSW Participation Rules for Electronic Conveyancing to respond promptly to NSW Land Registry Services and the Office of the Registrar General.

 
 

Keep your Subscriber details up to date on PEXA and Sympli

Please ensure that your Electronic Lodgment Network Operator (PEXA and Sympli) has your up-to-date Subscriber contact details (such as email addresses). The obligation for Subscribers to keep their details up to date can be found at Rule 6.2 in the NSW Participation Rules for Electronic Conveyancing. If you are unsure of how to update your details, please contact PEXA or Sympli.

2023/2024 NSW Land Registry services fees update

NSW Land Registry Services have provided an update on customer fees from 1 July 2023.

Fees relating to copyright
In line with the decision of the Copyright Tribunal of Australia on 28 October 2013, in the matter of Copyright Agency Limited v State of New South Wales, the additional fee payable for copyright purposes for the supply of a copy of a registered plan or part of a registered plan by electronic means for 2023/2024 is $1.36.
