Don’t Sabotage Your Case Before It’s Even Started

Avoid these top five employment claim mistakes.

At Jackson Spencer Law, we’ve seen strong employment cases crumble and weak ones flourish. The difference? Avoiding these five critical mistakes that can sink your claim before it even starts.

Mistake No. 1: Confusing “unfair” with “illegal”

Your boss is a nightmare. They play favorites, make unreasonable demands, and create a toxic atmosphere. Here’s the hard truth: being a terrible manager isn’t illegal.

Here’s some manager traits that won’t win your case:

  • General jerk behavior
  • Workplace nepotism
  • Disagreeing with your political views

What will win your case? Discrimination based on your protected class status (race, gender, age, disability, etc.) with concrete evidence and measurable damages.

Read on for the next four critical errors … but don’t worry, once you know to look for them, you can also avoid them to make your claim even stronger.

DON'T MAKE THESE MISTAKES

If you suspect that you are being treated unfairly at your job, or if you are facing discrimination or harassment, the lawyers of Jackson Spencer Law have decades of experience advocating for employees with such claims against their employers.

Meet Ones to Watch Honoree, Neal Bridges

From legal thrillers to State Fair dreams, Jackson Spencer Law partner Neal Bridges discusses his practice and what you can find him cooking up when he’s not advocating for his clients.

Do you have a personal philosophy that guides your legal practice?
First and foremost, empathy. For many individuals, their employment isn’t simply a contract between an employer and an employee; it’s about their livelihoods and their identities.

How do you recharge after a particularly trying case? It’s nice to focus on a project that requires a different kind of creativity than what I use for work, so I like to make my own homemade jerky and salsa. I don’t know if I’m ready to submit those recipes to the State Fair just yet, but my friends and family seem to like them!

Got a favorite legal movie or TV show?
The Devil’s Advocate with Keanu Reeves is the winner – it’s a good (albeit extreme) reminder of why we practice law in the first place: to help those who need it. For something lighter, My Cousin Vinny is a close runner-up.

If you could have any superpower, what would it be?
Truth detection! What lawyer wouldn’t want that as a superpower?
