NSW power of attorney and guardianship

In New South Wales, Power of Attorney and Enduring Guardianship are two separate legal documents that cover different areas of your life. While both allow you to appoint someone to act on your behalf, they cannot be used interchangeably for the same types of decisions.
Enduring Power of Attorney (EPA) - Financial/Legal
If you don't have one:
If capacity is lost without an EPA, the NSW Civil and Administrative Tribunal (NCAT) may appoint a financial manager
Purpose: Allows your attorney to manage your money, pay bills, sell real estate, and manage assets.
When it works: It can be set to take effect immediately or only if you lose capacity.
Process: You must have capacity to appoint an attorney over 18, and the form must be witnessed by a solicitor or authorized professional.
Enduring Guardianship (EG) - Lifestyle/Medical
Purpose: Appoints someone to make decisions about where you live, what medical treatment you receive, and services you use.
When it works: Only if you lose the capacity to make your own decisions.
Limitations: A guardian cannot make financial decisions or act against your known wishes.
If you don't have one: If needed, the NSW Supreme Court or NCAT can appoint a guardian.
Key Differences and Procedures
EPA
 = Money/Property; EG = Lifestyle/Health.
Appointing: These are separate forms. You can
Get started making a Power of Attorney via Service NSW.
Support: For complex cases, consult a solicitor, or find information through

Legal Aid NSW.
