Law Council welcomes passage of Constitutional Alteration to provide
for the Voice
On 19 June 2023, the Law Council of Australia welcomed the passage through the Senate of the Constitutional Alteration to establish an Aboriginal and Torres Strait Islander Voice to Parliament and the Executive. “With the passage of the Constitution Alteration (Aboriginal and Torres Strait Islander Voice) 2023 (Cth), there is now certainty that a referendum on the amendment to the Australian Constitution to provide for the Voice will be held later this year. The Law Council looks forward to date for the referendum being set,” Law Council of Australia President Luke Murphy said. “The Law Council has long supported a constitutionally enshrined Voice as a necessary and overdue recognition of First Nations peoples in the
Australian Constitution. The Law Council was pleased to make a submission and give evidence to the Joint Select Committee on the Aboriginal and Torres Strait Islander Voice Referendum inquiry into the Constitution Alteration. 2023 National Access to Justice and
Pro Bono Conference

The 2023 National Access to Justice and Pro Bono Conference was held last week in Brisbane. The Conference was co-hosted by the Law Council, Australian Pro Bono Centre and Queensland Law Society. The Conference was an opportunity for the various members of the legal assistance and pro bono sectors to reunite for the first time since the pandemic. Across the two-day Conference, more than 300 people committed to supporting access to justice for society’s most vulnerable. Feedback on the Conference received so far has been extremely positive. The Conference Program included a mix of plenary sessions and business sessions across four tracks: Legal assistance sector; Innovation and reform; Family law and access to justice; and Pro bono
services. A particular strength of the Conference is that it can draw on the significant knowledge and experience of eminent people to guide and enlighten the attendees across a range of topics of relevance to these sectors. Ceremonial sitting speech for the Honourable Justice Emilios Kyrou AO

Appointment of Justice Bromberg as President of the Australian Law Reform Commission
The Law Council of Australia strongly supports statements made on 23 June 2023, by the Honourable Debra Mortimer, Chief Justice of the Federal Court of Australia. The Chief Justice’s statements raise concerns about certain media coverage of the appointment of Justice Mordy Bromberg as the next President of the Australian Law Reform Commission (ALRC). The Law Council echoes Chief Justice Mortimer’s remarks that, for more than a decade, Justice Bromberg has served the Australian community commendably as a highly respected, fair minded and dedicated member of the Federal Court. The operation of Commonwealth FOI laws submission
The Law Council recently made a submission to the Senate Legal and Constitutional Affairs References Committee in relation to its Inquiry into the operation of Commonwealth Freedom of Information (FOI) laws. This submission was informed by input from several Constituent Bodies, in addition to the Federal Dispute Resolution Section’s Administrative Law Committee. It emphasises that the transparency
afforded to the FOI scheme, through the Freedom of Information Act 1982 (Cth) (FOI Act), is critical to the effective operation of the administrative law system and, more broadly, to the integrity of Australia’s democratic institutions. Read the full article here.

The Mahla Pearlman Oration honours the memory of the late Honourable Mahla Pearlman AO, the former Chief Judge of the Land and Environment Court of New South Wales (1992–2003), and former President of the Law Council of Australia (1989–90).
