Best Practice Guides for Legal Practitioners in Relation to Elder Financial Abuse and Assessing Mental Capacity

 

On World Elder Abuse Awareness Day, 15 June 2023, the Law Council has published a revised Best Practice Guide for Legal Practitioners in Relation to Elder Financial Abuse to help lawyers to identify potential incidents of abuse, particularly financial abuse, of older Australians and take steps to respond.

“Lawyers are at the frontline in terms of recognising and preventing elder financial abuse,” Law Council of Australia President, Mr Luke Murphy said.

“This is because of the role that lawyers play with the preparation and execution of wills and other advance planning documents.  These are important contexts in which the risk of elder financial abuse may arise.”

The updated Best Practice Guide—Elder Abuse sets out best practice measures which legal practitioners should adopt to identify and respond to the risk of elder financial abuse arising in the execution and performance of such documents.

“Elder abuse is completely unacceptable and sadly the perpetrators are usually someone very close to the victim, someone the person should be able to trust to care for them and have their best interests at heart when they are at their most vulnerable,” Mr Murphy said.

Accompanying the Best Practice Guide—Elder Abuse for the first time is a Best Practice Guide for Legal Practitioners on Assessing Mental Capacity.

Law Council congratulates Margery Nicoll on King's Birthday Honours Award

The Law Council of Australia congratulates its Deputy Chief Executive Officer, Ms Margery Nicoll on being awarded a Member of the Order of Australia (AM) in the 2023 King's Birthday Honours list.

Law Council President Luke Murphy said that Ms Nicoll has been an integral part of the organisation since 1986.

Scoping legal services pilot for victims of sexual assault

The Law Council of Australia provided a submission to the Attorney-General’s Department in response to the Discussion Paper 'Scoping the development of specialised and trauma-informed legal services for victims and survivors of sexual assault'. This submission addresses questions 8 to 12 of the Discussion Paper.

The Law Council supports the National Plan to End Violence against Women and Children (National Plan) and is committed to advocating for meaningful reform to protect victims and survivors of sexual violence and uphold a fair, just and accessible legal system in Australia.

Humanitarian Program 23-24

On 9 June 2023, the Law Council lodged a submission in response to the Australian Department of Home Affairs (the Department) Discussion Paper regarding Australia’s 2023 – 2024 Humanitarian Program.

As stated in the Discussion Paper, the Humanitarian Program (the Program) ‘provides resettlement for refugees and others who are displaced as a result of conflict, persecution and human rights abuses’. Each year, the Department publishes a discussion paper to inform the public and seek their views on the management and the composition of the Humanitarian Program.

The Mahla Pearlman Oration honours the memory of the late Honourable Mahla Pearlman AO, the former Chief Judge of the Land and Environment Court of New South Wales (1992–2003), and former President of the Law Council of Australia (1989–90).
