PRIVACY CODE (MARKET AND SOCIAL RESEARCH) CODE 2021

In our current data-centric environment, keeping Australians' personal information private is more important than ever. As technology evolves and new risks emerge, ADIA regularly reviews and strengthens our industry's privacy safeguards to maintain public trust, which is essential to our members' operations.

In line with Part G of the Privacy Code and OAIC Code guidelines, ADIA has engaged the Hon. Terry Aulich to conduct an independent review, as required by law. The Review meets the OAIC obligations and will assess whether the Code meets its objectives and remains effective and relevant. 

The recommendations address the following areas:  

  1. ADIA’s privacy culture and practice
  2. ADIA’s Code and any new clauses and explanatory notes that should be included in the revised version of the Code.

Key areas reviewed and reported on (see Section 2):

  • 2.1 Training, Privacy Awareness Raising and Design
  • 2.2 Privacy compliance and practices of both ADIA and its members (that is, how the Code operates in practice)
  • 2.3 Internal governance of ADIA and privacy
  • 2.4 Standards.

Recommended changes to the code and related privacy practices and policies (see Section 4):

  • 4.1. Artificial Intelligence: Reviewer recommendations
  • 4.2 Children and Youth Privacy: Reviewer’s Recommendations.
  • 4.3 Overseas sharing of personal information: Reviewer’s Recommendations
  • 4.4. Enforcement: Reviewer’s Recommendations
  • 4.5 Responsible Privacy Officer: Reviewer’s Recommendations
  • 4.6 Annual Compliance Survey: Reviewer’s Recommendation
