Reform of Australian data privacy rules have been heralded for years, and little has happened. Regulated entities could be forgiven that thinking that it is all white noise that can be ignored until the politicians work out what to do and pass ‘tranche 2’ amendments. But over the last year and below the headlines, a refreshed and additionally empowered Australian Privacy Commissioner has been quietly reinterpreting the law and using new enforcement powers to discipline entities that don’t understand and apply the reinterpreted rules. All data-enabled entities are now in the Commissioner’s sights. Oxfam Australia was a recent defendant. Penalties, and public naming and shaming, are new enforcement tools. The changes are wide-ranging. They likely require data governance process changes within your organisation. ‘Papering your way to compliance’ is no longer a safe option.
