This issue includes news of the swearing-in of Sir Timothy Le Cocq as a Commissioner of the Royal Court, the appointment of Mr Mark Temple KC as deputy bailiff, and the swearings-in of two Court of Appeal judges, eight new advocates and two new écrivains. There is news of the appointment of Charlotte Brambilla as the new chair of the Jersey Law Commission, and the Employment section below carries information on applying for Law Commissioner roles with the Jersey Law Commission.

Legal aid news includes notice of revised capital and income threshold limits, and details of a vacancy in the Legal Aid office (see the Employment section below).

Revenue Jersey has issued a warning relating to members' firms with associated service companies and their GST registrations (or lack thereof - see further below).

Further reminders relating to members' obligations as regards CPD, and a number of court-related, government and regulatory announcements are also included, along with wellbeing, education and employment updates.

Former Bailiff Sworn In as Commissioner

Former Bailiff, Sir Timothy Le Cocq, was sworn in on Monday 10 November 2025 as a Commissioner of the Royal Court of Jersey and as a Judge of the Jersey Court of Appeal.

Mark Temple KC Announced as New Deputy Bailiff

Attorney General Mark Temple has been announced as Jersey's new Deputy Bailiff.

His Majesty the King approved the appointment, which was announced in the States Assembly on 21 October 2025.

Mr Temple will succeed Mr Robert MacRae as Deputy Bailiff, and said the appointment was a "great honour".

Mr Temple moved to Jersey in 2003, and was admitted as an advocate in 2005. He specialised in litigation and dispute resolution in private practice in Jersey and was appointed a Queen's Counsel, now King's Counsel, in 2015.

Mr Temple served as the Island's Solicitor General between 2015 and 2020, when he became Attorney General.

The new Deputy Bailiff will be sworn in during January 2026.

Swearing In of Judges of Court of Appeal – 24 November 2025

Mr Angus McCullough KC and Mr Roderick Dunlop KC will be sworn in as Judges of the Jersey Court of Appeal on Monday 24 November 2025 at 9:45am.

The Bâtonnier would greatly appreciate the attendance in court of advocates who will be appearing before the Court of Appeal next week.

Swearings In of New Advocates and Écrivains – December 2025

Eight new advocates and two new écrivains will be sworn in at Royal Court ceremonies in December, following their completion of the qualifying examinations.

New Chair of Jersey Law Commission Appointed

Charlotte Brambilla was appointed as the new Chair of the Jersey Law Commission on 23 September 2025.

She is a qualified Jersey Advocate and English Barrister. She has worked for the last 20 years or more in Jersey, primarily in its finance sector in one capacity or another.

She has held senior roles in both the public and private sector. She has worked in London and in Jersey at top tier law firms, specialising in private wealth.
While in Government, Charlotte led on the Ministerial refresh of Jersey's financial services policy framework, and its sustainable finance policy while also delivering a comprehensive update to Jersey's Limited Partnership Law and designing and delivering the first phase of a policy framework for pension regulation in the Island.

She was an executive board director at a local international trust company and has held a senior regulatory and governance role at a global bank. 

Presently, Charlotte is Head of Legal, Policy and Compliance at the Financial Ombudsman, a pan island body serving the needs of the Channel Islands' financial services industry and its consumers.

Charlotte is committed to the Island and to supporting the wellbeing of its economy and its community while also maintaining its reputation within the international community.

Her primary object for the Jersey Law Commission is to reinstate it as a trusted, respected and collaborative stakeholder in the review and modernisation of the laws of Jersey, and to make its Work Programme relevant to the commercial and social needs of Jersey, both domestically and abroad. She is looking for experts to support her in achieving these aims (see the Employment section below).

Advocates and Solicitors Examination Success

Three candidates completed their Advocates and Solicitors Examinations in the September sitting.

The successful candidates, to whom we offer our congratulations on their achievement, are:

Payment Diversion Fraud in Property Sales

The UK National Crime Agency and The Law Society of England & Wales have launched a joint campaign aimed at solicitors and conveyancers to protect against payment diversion fraud in property sales.

The Law Society of Jersey wishes to draw the attention of practitioners to the risks of payment diversion fraud and to support the aims of the campaign.

Payment diversion fraud during property sales involves criminals intercepting and redirecting legitimate property purchase funds by impersonating lawyers, estate agents or buyers through fraudulent contact. The aim is to manipulate victims into transferring funds to the fraudsters instead of their legitimate destination.

The campaign provides solicitors and conveyancers with practical guidance on identifying and preventing this fraud.

Code of Conduct - CPD Requirements - Final Push for 2025

Ordinary Members of the Law Society will be well aware of their obligation to complete not less than 15 hours per annum of CPD.

The CPD requirement does not apply to individuals in the year in which they are sworn-in. Non-Practising Members do not have a CPD obligation, although they are encouraged to undertake relevant CPD in respect of the role they are undertaking.

Now that we are closing in on the end of the year, members are strongly encouraged to review their CPD activity to ensure that sufficient CPD is completed before the end of 2025 - learn now to avoid the year-end rush !

Legal Services Bodies - Amendments to Membership

Law firms operating as LLPs which have been recognised by the Law Society of Jersey as Legal Services Bodies ("LSBs") are reminded that any changes in the membership of the Legal Services Body must be advised to the Law Society in advance of the effective date of such changes.

Firms are reminded that any changes to their:

Where firms maintain a PO Box or JE1 address which does not include a physical office address, firms must provide the Law Society and the Court with a physical address for service purposes.

Members are reminded that it is their personal responsibility to update the Law Society in respect of:

• change of firms
• change of circumstances
• change of contact details

Members are reminded of the importance of advising the Society of any changes in circumstances or firms.

Notification MUST be provided, in all cases, in advance of the effective date of the change.

All proposed changes must be advised by completion and submission of the Membership Update Form.

COURTS & GOVERNMENT

Amendments to Legal Aid Financial Eligibility Thresholds - Effective January 2026

Under the terms of the Legal Aid Scheme, the Capital and Income Limits, in respect of eligibility for Legal Aid, are adjusted on an annual basis, in line with changes to the Median Average Earnings, as detailed in the Government's Average Earnings Report as at June each year.

As a consequence of the reported Median Average Earnings for Full Time Employees increasing to £890 per week (from £850 per week in 2024), with effect from 1 January 2026, the relevant capital and income thresholds will be amended as follows:

Capital Limit (Individual)

Public Law (Criminal / Human Rights) £70,000
Private Law (Family / Civil matters) £70,000

Income Limit (Individual)

Public Law (Criminal / Human Rights) £70,000
Private Law (Family / Civil matters) £47,000

Applicants have to satisfy both the capital and income tests in a qualifying area of law to be granted Legal Aid. Legal Aid will not be granted where the capital and/or income limits are exceeded.

Revenue Jersey Warning to Firms with Associated Service Companies

Revenue Jersey has come across a number of instances where law firms with associated service companies are not fully complying with the requirements under the Goods and Services Tax (Jersey) Law 2007.

In particular, Revenue Jersey has noted that that whilst the law firm itself may be registered for GST, the service company may not be, despite the fact it is required to do so if its turnover breaches the threshold amount (currently £300,000). This leads to subsequent errors in declarations and returns. The Comptroller is of the opinion that this situation would in some circumstances create significant risks for both the firm and public purse.

The Comptroller urges firms to review their position in relation to GST, especially as to whether they have the necessary registrations. If there are issues, his officers are available to help, please email GST@gov.je.

Children and Civil Status Law in Force

A new package of legislation will come into force in Jersey from 24th November 2025, significantly modernising Jersey's family law by strengthening the rights and legal recognition of same-sex parents, parents who conceive through fertility treatment, and families formed through surrogacy.

This legislation represents a significant milestone in advancing the rights of children and families, ensuring that every child, regardless of the circumstances of their conception, has their family relationships legally recognised and protected.

Key changes include:

Registration: Please contact the Office of the Superintendent Registrar.

  • Joint registration on their child’s birth certificate for parents who undergo fertility treatment together using donor sperm, including mixed-sex parents and same-sex female parents. This applies to couples who are married or in a civil partnership or who use the ARU in Jersey or a regulated fertility clinic in the UK.
  • Re-registration for existing same-sex female parents whose children were conceived through donor sperm and registered before 24th November 2025, so that both parents may be named on the birth certificate. This applies to parents who were married or in a civil partnership at the time of conception, or who used the ARU in Jersey or a regulated fertility clinic in the UK. It will not apply to same-sex female parents who have already adopted their children.
  • Abolition of the concept of legitimacy, to remove the outdated status and ensure all children are registered equally in law at birth. This includes enabling historic birth records to be corrected and re-registered with the biological father when the mother’s husband was incorrectly registered due to a legal presumption that he was the child’s father.

Parental Orders and Parental Responsibility Agreements: Please contact Family Division of the Royal Court

  • Parental orders for individuals or couples whose children are born in Jersey via surrogacy. This will provide full parental rights and responsibilities to the intended parents and extinguish the surrogate’s parental rights.
  • Recognition orders for Jersey-born children via surrogacy whose parents have already obtained a parental order in England or Wales before 24th November 2025. Most of these parents will be contacted directly via letter. However, parents who are unsure should seek specialist legal advice.
  • Ability for stepparents to gain parental responsibility for their stepchildren via a parental responsibility agreement with the child’s birth parents and anyone else with parental responsibility for the child.

Tour the States Chamber or Lunch and Learn: Your States Assembly

With the election approaching next June, the States Greffe is keen for all Islanders to learn more about Jersey’s political system and the electoral process.

With this in mind, they would like to offer two initiatives to members of the Law Society:

Tour the States Chamber

This informative behind-the-scenes tour of the States Chamber is offered by the team at the States Greffe. The tour covers the inner workings of the States Assembly and how decisions are made that impact you and your colleagues both personally and professionally.  This informal tour usually takes an hour, with the opportunity to ask questions throughout.

Tours are slotted in around States Assembly meetings and staff availability. Ideally, the States Greffe would suggest a minimum of 10 participants, but we are used to accommodating larger groups of up to 25 or more.

In-Person Lunch and Learn: Your States Assembly and Voting in Jersey

This 30-minute in-person lunch and learn session gives participants the opportunity to learn more about Jersey’s political system and how the electoral process works, including the who, what, where and how of voting in 2026. The session includes a 20-minute presentation, followed by a 10-minute Q&A. Please note the length and nature of this session can be adapted if required.

Access to Beneficial Ownership Information - Consultation

The Government of Jersey has ​​​launched a consultation seeking views on proposals to extend access to the central register of beneficial ownership to persons who demonstrate a legitimate interest in accessing beneficial owner information for the purpose of preventing, detecting, or investigating money laundering, terrorist financing and proliferation financing.

The Government is inviting views from stakeholders and the wider community to help shape policy to enable Jersey to meet its international commitments while maintaining a fair, proportionate, and effective framework.​

Responses to the consultation​ should be submitted no later than the close of business on 30 January 2026. Pos​tal submissions must bear a postal date no later than that date.

Children and Families Hub & Jersey Family Court Advisory Service : Advice Sessions for Parents

We know that parenting after separation can feel overwhelming at times.

That’s why the Children and Families Hub have teamed up with the Jersey Family Court Advisory Service (JFCAS) to offer free, confidential one-to-one appointments for parents and carers.

What JFCAS can do:

  • Listen and talk through the challenges of co-parenting
  • Share options to help you move forward as a separated family
  • Offer advice on creating safe, child-focused arrangements
  • Explain how children’s needs are considered in Family Court proceedings

What JFCAS can’t do:

  • Provide legal advice
  • Take on casework outside of Family Court
  • Make decisions for you - but they will help you explore your choices.
  • These sessions are a chance to get clear, independent advice to help you make the best decisions for your children and your family.

REGULATORY NEWS & UPDATES

Revised Implementation Date for AML/CFT/CPF Handbook enhancements

In response to industry feedback, the JFSC has deferred to 31 May 2026 the implementation date for the proposed enhancements to the AML/CFT/CPF Handbook, including requirements for enhanced criminal background checks.

Countries and Territories in AML/CFT/CPF Handbook Appendices Updated

The JFSC has updated appendix D1 and appendix D2 of the AML/CFT/CPF Handbook, in response to the latest Financial Action Task Force (FATF) statements of 24 October 2025. 

To see what has changed, go to their amendments log.

What this means

Effective immediately, countries and territories listed under Sources 1 and 2 of the amended Appendix D2 should be treated as not compliant with FATF Recommendations for the purpose of Article 17A of the Money Laundering Order.

Next steps

Supervised persons should:

  • review policies, procedures, and existing customer relationships, to assess the impact of these updates on their business
  • take particular care when considering placing reliance on an obliged person based in one of these countries and territories
  • discuss any concerns with your supervisor

Supervised persons may be required to undertake additional actions to mitigate the risk.

CIFO Complaint Numbers Q3 2025

Complaint numbers for July – September 2025 have been published.

In the third quarter of 2025, CIFO received 159 complaints and opened 115 new cases – these are complaints that are within CIFO’s mandate to review as set by law.

Of the new cases opened this quarter, the top products were: current accounts (62%), health insurance (10%) and home emergency insurance (8%).

The top issues complained about were: fraud (24%), suspension of service (19%), and poor administration or delay (17%).

In the third quarter of the year, 214 complaints were closed, of these:

  • 36% could not be dealt with as they were outside the scope of CIFO's mandate as set by law;
  • 52% were mediated or determined by an Ombudsman;
  • 8% were cases where an FSP made a further offer which was accepted before CIFO had fully investigated; and,
  • 4% were withdrawn by the complainant after coming to CIFO.


Just over half (55%) of the 110 mediated or determined complaints were found in favour of the complainant, with the remaining complaints (45%) found in favour of the financial service provider.

New Sound Business Policy Effective 1 November 2025

The Government of Jersey and the Jersey Financial Services Commission have issued the new Sound Business Policy, effective 1 November 2025.

This policy replaces the JFSC's former Sound Business Practice Policy and is intended to strengthen Jersey's position as a leading international finance centre, making it easier to do business, through effective regulation.

To support the implementation of the new policy, the JFSC will be hosting one further drop-in session in November, and an added session in December, which can be booked here (very limited availability):

Consumer Credit Consultation

A new consumer credit regulatory framework, previously announced by the JFSC in collaboration with government and industry stakeholders, is now moving into a consultation phase, with the States of Jersey now scheduled to consult on the secondary legislation required to implement the regime in November 2025. The JFSC will then aim to consult on the consumer credit business Code of Practice in Q2 2026.

Data Protection in Practice - Insights Survey 2025

The Jersey Office of the Information Commissioner ("JOIC") has teamed up with the Isle of Man Information Commissioner’s Office to launch an anonymous Data Protection in Practice – Insights Survey 2025’.

Jersey businesses should have received an email regarding the survey from JOIC via the Data Protection Officer / Data Protection Lead detailed in their registration database.

The survey is not an audit and it is not enforcement. It is a chance for organisations to share how they are handling data protection and where they are finding it tough. The survey aims to:

  • Understand the practices in place in the areas of data sharing, training, impact assessments, right of access and breaches
  • Inform the future design of tailored guidance and support
  • Strengthen the overall data protection culture across each island.

The Information Commissioners of both islands hope to understand how they can better support organisations with the real data protection challenges they are facing. Your insights will help shape future guidance, outreach and support.

They invite your organisations to take part in the survey, which should take only 20-25 minutes.

They are encouraging organisations to answer openly and honestly, as they consider that the more accurate the information received, the better they can tailor future guidance and practical support to meet the needs of organisations.

Anonymised responses will be analysed and reviewed to develop and shape future guidance and resources.

Individual organisations cannot be identified nor highlighted in the published outcomes.

Safe Places Scheme Launched to Build a Safer, More Inclusive Community

The Government of Jersey, through its Building a Safer Community, BASC, initiative, is proud to announce the launch of the Safe Places Scheme, a community-driven effort to create a network of safe, welcoming locations across the Island for anyone feeling vulnerable, intimidated, or at risk.

From banks and cafés to Parish Halls and sports clubs, businesses and organisations across Jersey are invited to register as ‘Safe Places’, offering refuge and support to those in need.

Vacancy - Administrator (Part Time) - Legal Aid Office

The Law Society of Jersey is seeking to recruit an Administrator to provide part time support / holiday cover in the Legal Aid Office.

Working hours:  Average 15-20 hours per week over course of year, including training in first year.

Job Purpose

• Day to day administration of the Legal Aid Scheme (Part time)

Role and Responsibilities

• Public liaison/query management
• Firm liaison/query management
• Scheme administration
• Application processing
• Certificate issue
• Claims management
• Holiday/absence cover for Senior Administrator, Legal Aid

This role specifically requires the jobholder to provide holiday/absence cover for the Senior Administrator (up to 6 weeks @ 35 hours per week) plus part time working @ 10-12 hours per week. Average 15-20 hours per week.

On recruitment, an initial training period of 6 weeks (full time) will be required.

Vacancies for Law Commissioners, Jersey Law Commission

The Jersey Law Commission is an independent body established to review, modernise, and improve the law of Jersey. Its role is to research areas of law that may be outdated, unclear, or in need of reform, and to make recommendations to ensure Jersey’s legal framework remains fair, effective, and accessible.

The Jersey Law Commission invites applications for the position of Law Commissioner in the following areas:

·         Criminal Law,

·         Family Law,

·         Property Law,

·         Constitutional Law,

·         Commercial Law,

·         Succession Law, and

·         Insolvency Law.

Applicants must be practising Jersey lawyers or academics with a recognised specialism in Jersey law.

Candidates should be Jersey residents or have a demonstrable strong connection to Jersey. They should be recognised experts in their chosen field.

The role of a Law Commissioner is a voluntary unpaid role. Commissioners contribute their expertise and time to the work of the Commission on a voluntary basis, reflecting their commitment to public service and the advancement of law reform. The time commitment involves attendance at meetings once a quarter, together with additional project work as required.
