Agriculture Update

With the majority of the UK working from home or isolating, more and more people will be taking a daily stroll through the countryside or surrounding area in which they live, especially in good weather.

Whilst the majority stick to known paths, there are the few who are venturing onto land that is not a designated footpath, bridleway etc.  Most will go unchallenged because as farmers you’re covering a large area but from a health and safety perspective, with farm machinery in operation at this peak period, it is essential to know where the public can access across your land.

One or two may not be an issue, but it will become increasingly enticing to the public to walk around the picturesque areas in which we live and work.

The following points are questions to ask yourself as a landowner:

  • Is there adequate signage to show private and public access? Consider what type of Notice is required in order to cover both private and public access. The wording of these is crucial.
  • Do you challenge walkers, ramblers, joggers and helpfully steer them back onto the correct footpath?
  • Have you completed a Deposit of Plans with your local Council? This will prevent the establishment of new public rights of way across your land.

Ashtons Agriculture & Estates team is here to help and would be delighted to discuss this further with you and help keep you, your workers and the public safe whilst enjoying the countryside.

If you wish to discuss this or any other issues please contact us: rachel.chilton@ashtonslegal.co.uk or 01284 727089.
