Alert

November 2024

You are receiving this Regulatory Alert because you operate a regulated early childhood education and care service in South Australia. Please share this important information with your educators and staff.

Important information about a Registered Training Organisation

Regulatory action being taken by the Australian Skills Quality Agency (ASQA) has potential impacts on South Australian early childhood educators, services and providers.

The Australian Government has advised that ASQA has cancelled the registration of a Registered Training Organisation (RTO), Luvium Pty Ltd, (trading as Australia Education & Career College) and this may affect qualifications issued from January 2023, in a number of sectors, including early childhood education and care and first aid.

ASQA has notified affected all students. The Education Standards Board, as the regulatory authority of the early childhood education and care sector in South Australia, is working with ASQA, other government agencies and regulators, and the sector to ensure impacted services are notified as soon as possible.

Our priority is the health, safety and wellbeing of children. We will work with impacted providers and services to meet regulatory requirements and operate safely.

Information for impacted educators

ASQA has written to students who obtained a qualification from the RTO between 1 January 2023 and 19 October 2024, giving notice of intent to cancel their qualification and providing the opportunity for students to reply.  Students issued qualification(s) and/or statements of attainment during the relevant period have 7 days to respond after receiving ASQA’s notice of intent and no decision will be made on qualifications until ASQA has considered responses from affected former students.

Affected educators should advise their approved provider so that any impact on qualification and ratio requirements can be planned for and managed.

Information for approved providers

Approved providers and nominated supervisors are responsible for the qualifications of their staff.  It is important that you check your records of staff qualifications to see if any current members of staff are impacted.

If you believe you may be impacted by this issue, you are encouraged to refer to the ASQA website for further information.

If you are concerned about maintaining ratios and meeting qualification requirements due to staff impacts, please contact the Regulatory Authority to discuss possible actions you can take.

Reporting concerns regarding qualifications

If you have concerns about an RTO, or the qualifications of an educator, please contact ASQA on 1300 701 801 or submit a report via its Contact us page.

Educators who have concerns about their qualifications should also contact ASQA for guidance.

Information on qualification requirements

Providers and educators can access further information about qualification requirements on the ACECQA website.
